【摘要】 “弱者,你的名字是女人”。莎士比亚的这句名言似乎昭示出了几千年来女性的命途多舛。随着非婚同居现象的日益发展,由非婚同居带来的纠纷日渐增多,在这些纠纷中,往往都是女性权益受到侵害。由于现行法律规定的缺失,使得女性权益被侵害时往往得不到相应的救济,女性为非婚同居付出了沉重的代价,承担着非婚同居带来的不幸,但是男性在非婚关系解除时,几乎不用承担任何责任,这种男女权益失衡的现象正是促成笔者思考本文的出发点。从国外立法来看,《埃塞俄比亚民法典》的非婚同居制度中确立了对女性权益独具特色的保护制度,英国政府也在其拟建立的统一的非婚同居法中,将注重对女性权益的保护作为一项基本原则,拟在非婚同居制度设计中赋予女性更多的权利,保障女性合法权益。因此,构建我国的非婚同居制度,并注重对女性权益进行保护,无疑也是符合国外立法趋势的。全文除引言外,分四个部分,共计三万余字。第一部分介绍了非婚同居的概念,根据本文的研究内容,基于法律应当对非婚同居关系给予适当的调整和保护的初衷,笔者对非婚同居的概念界定为：非婚同居,是指具有完全民事行为能力的未婚男女之间持续、共同生活的事实状态,是家庭组成形式的一种。第二部分从三个方面介绍非婚同居制度构建中保护女性权益的必要性：第一,现实原因,非婚同居关系中女性权益易受到侵害；第二,理论原因,对女性特殊权益的肯定和弱势地位的保护；第三,法律原因,完善我国法律体系建设的需要。第三部分笔者考察了国外规制非婚同居的法律制度。总的来说,当前国外规制非婚同居的法律制度有三种,一种是同居合同制度,一种是事实婚姻制度,一种是非婚同居身份关系制度,从女性权益保护角度出发,笔者比较了上述三种模式的优劣,认为非婚同居身份关系模式对女性权益保护更优。目前国外对非婚同居进行规制大多也采用这种制度。第四部分笔者结合我国的实际情况,在非婚同居制度构建中,在参考其他学者研究成果和国外立法经验的基础上,从注重保护女性权益的要求出发,设计了一些具体的权利制度和原则,如应当承认非婚同居合同的效力,确立非婚同居关系解除时财产问题的处理规则,明确非婚同居期间侵权行为的可诉性,建立非婚同居遗产继承权制度等。更多还原

With its development, unmarried cohabitation of the dispute is increasingly, in these disputes, women are often due rights and interests are infringed upon, the lack of law, women’s rights are not infringed upon the corresponding relief, women unmarried cohabitation is paid a heavy price for unmarried cohabitation, bring misfortune, but men in the marriage relationship removes almost no responsibilities, and the unbalance of the rights to the author of the paper is thinking.From abroad, the legislation of civil code of Ethiopia unmarried cohabitation system is established for women’s rights protection system of unique, the British government to establish in the unity of the premarital cohabitation method, pays great attention to the protection of women’s rights as a basic principle in the premarital cohabitation, system design in giving women more rights, security, therefore, the legitimate rights and interests of women unmarried cohabitation of constructing system, and pay attention to protect women’s rights, certainly also conforms to the trend of foreign legislation.Full citations, except four parts, totaling more than thirty thousand words.The first part introduces the concept of unmarried cohabitation, according to this study, based on the law of content should be unmarried cohabitation appropriate adjustment and protection of the original author, unmarried cohabitation concepts:the premarital cohabitation, it is to point to have full civil capacity of single men and women between the facts together and form, is one of the forms of the family.The second part is introduced from three aspects in the construction of unmarried cohabitation system to protect women’s rights, the necessity of practical reasons:first, unmarried cohabitation of easily encroached on women’s rights, Second, the theory of reason, the special rights and interests of women and weak protection, Third, the legal reason, perfecting the legal system construction.The third part of the author examines the unmarried cohabitation of foreign regulation law system. Generally speaking, the unmarried cohabitation of regulating foreign legal system has 3 kinds, one kind is cohabitation contract system, one is the fact that the marriage system, a kind of wrong marriage relationship, from living status to women’s rights protection system, the author compared the Angle of the three modes of unmarried cohabitation, think of female identity model more rights protection. Now for the premarital cohabitation abroad mostly by regulating the system also.The fourth part according to the actual situation of China, in the premarital cohabitation system construction, in reference to other scholars research results’and based on the experience of foreign legislation, protection from women’s rights to the requirement of design, the specific rights system and principles, such as should admit the premarital cohabitation the effectiveness of the contract, the establishment of unmarried cohabitation terminate when processing property, establish rules and unmarried cohabitation tort compensation system, establish certain conditions of unmarried cohabitation inheritance system, etc.更多还原
