信访立法

【摘要】 我国的信访制度作为一种具有中国特色的权利救济的方式,为广大人民群众参与国家管理开辟了渠道,同时,作为一种互动的社会监督方式,使人民在监督国家机关及其工作人员的违法行为力度上得到了加强。然而随着社会的发展和依法治国方略的提出,其如何与宪政和法治理念相协调的问题值得关注。本文以法律的视角作为切入点,通过对我国现行信访制度的现状分析,试图借鉴世界各国和地区类似制度成功经验的基础上,完善此种特殊的行政救济方式,整合与重构我国的信访制度,建立有中国特色的信访专员制度,通过立法,制定信访专门法,使信访制度在法治的轨道上良性运行。

【Abstract】 China’s petition system with Chinese characteristics as a right of way of relief for the broad masses of the people involved in the state has opened up a channel at the same time, social interaction as a mode of supervision, so that the people in monitoring the state organs and their staff of the law efforts on behavior has been strengthened. However, with the social development and the rule of law strategy proposed, its role has become increasingly weakened, or even in a sense with the idea of constitutional government and the rule of law is becoming further and further away. At the same time, the drawbacks of the system because of their highlights of the traditional system of letters and visits to the gateway of the system changes. From the legal perspective in this article as a starting point, through the petition system in our country the status of the current analysis, trying to learn from other countries and regions in the world’s successful experience with similar systems on the basis of the sound of such a special way of administrative relief, integration and reconstruction of China’s petition system the establishment of Chinese characteristics Commissioner Petition People’s Congress system, through legislation, letters and special law, to make letters and the rule of law system in the healthy operation of the track.
