【摘要】 居民委员会与业主委员会是我国两个城市基层群众组织。法律分别授予其一定的职责,根据不同的职责,两个组织分别具备一定的社会功能。由于职责存在交叉部分,导致两个组织在自治功能以及民主训练功能方面出现功能重合。功能上的重合常常引发现实中的冲突,如居民委员会与业主委员会对同一自治事务共同行使自治权、居民委员会干涉业主委员会的组织成立等。在当前社会转型时期,城市基层社会的稳定是社会和谐的重要基石,代表不同群体利益的居民委员会与业主委员会两个组织如果能够充分发挥消除基层社会矛盾、化解不同群体利益冲突的功能,对于我国今后的发展能够起到重要的推动作用。本文通过运用比较研究的方法分析了居民委员会与业主委员会两个组织依法所具备的功能,在此基础上对两个组织所具备的相同功能进行了进一步分析,指出了自治功能及民主训练功能存在冲突以及在现实中的表现,找出功能冲突存在的立法原因和利益冲突原因,最后给出功能冲突的化解措施,即完善立法、加强合作、资源互补、政府监管。本文的创新之处在于从功能冲突的角度分析居民委员会与业主委员会之间的关系,指出城市基层组织之间存在的矛盾,并提供了解决办法。更多还原

【Abstract】 Neighborhood committee and the owners committee are the masses of our country both urban grass-roots self-government organizations. Must separately grant legal responsibilities, in accordance with different responsibilities, respectively, with both organizations must social functions. Duties because of cross-existence of two organizations in the cause functional autonomy and democratic functions of functional training coincidence. Function usually triggered on the coincidence of the reality of conflict, such as neighborhood and the owners of the same degree of autonomy Affairs Committee jointly exercise autonomy, neighborhood property owners to interfere in the establishment of such committee. In the current social transition, the urban grass-roots social stability are an important cornerstone for social harmony, on behalf of the interests of different groups of residents and owners of the Commission if the two organizations be able to give full play to the elimination of grass-roots social contradictions, and resolve conflicts of interest of different groups of features, for our country future development can play an important role.In this paper, through the use of comparative study of methods of analysis of the neighborhood committee and the owners of the two organizations in accordance with the law functions, on the basis of the two organizations have the same function for further analysis, pointed out the functional autonomy and democracy training functions exist conflict, as well as in reality the performance of functions of the conflict to identify the reasons for the existence of legislation and conflict of interest reasons, and finally give the functional measures to resolve the conflict, namely the improvement of legislation, strengthen cooperation and complementarity of resources, government supervision.In this paper, the innovation lies in the conflict from the perspective of functional analysis of the neighborhood and the relationship among the owners that the city grassroots autonomous organizations of the contradictions between the existence and provide the solution.更多还原
