评析我国的不动产善意取得制度及在司法实践中的具体适用

【摘要】 不动产善意取得,指受让人因信赖登记证书而与无权处分不动产的让与人交易,如受让人取得该不动产时系出于善意,则取得该不动产的所有权,不动产原所有人不得要求受让人返还原物。善意取得制度在不动产领域的运用,能较好地保障善意第三人的合法权益,当所有权与交易安全发生冲突时,能够在二者之间找到恰当的平衡点。善意取得制度是适应商品经济发展需要而产生的一项交易规则,涉及民法所有权保护与交易安全之衡量与价值问题,为近代以来大陆法系和英美法系民法一项十分重要的法律制度。善意取得适用于动产领域历来没有争议,但是否适用于不动产领域,各国立法规定不一,学界亦存不同见解。我国《物权法》初次引入了不动产善意取得制度,本文试图通过对善意取得制度的历史渊源、立法比较、实践基础等诸方面的研究,寻求在不动产领域建立善意取得制度的理论依据,并以我国《物权法》的规定为基点,通过对不动产善意取得的构成要件和法律效力的分析,探索不动产善意取得制度的构建模式及在实践运用中需注意的诸多问题。

【Abstract】 The bona fide acquisition of real estate, refers to the assignee do the deal according to the registration certificate and trust with the transferor who in fact has no right to real estate transactions. If assignee obtains the realty with good faith, he will get the ownership of the realty, the original ownership of the real estate can not require the return. The good faith acquisition system in the field of real estate, can better safeguard the lawful rights and interests of third party, when the ownership and transaction security conflict, can find the right balance between them.This system is adapted to the commodity economy development, include very important civil law rules. These trading rules measure and value civil protection and transaction security of ownership in the modern time continental law system and common law system. Good faith applicable to movable property field is not controversial, but if it is applicable to the real estate sector, legislation, scholars also save different opinions. Our property law first introduced the good faith acquisition rules, this paper has compared the historical origin, legislation and practice base of research in the real estate sector, established the theoretical basis of the system in China, and the provisions of the our property law, through the analysis of the components and the legal validity analysis system, explore the construction model and the practical application.
