【摘要】 土地作为一种自然资源和社会财富,是农民生存的条件和重要的社会保障。以家庭联产承包责任制为基础的土地承包经营制度的实行,激发了我国几亿农民原有的对土地的激情,提高了农村生产力,促进了农村经济的发展。然而在新的历史阶段,随着改革开放的逐步深化,农业产业化的进程加快,在历史上发挥过重要作用的土地承包制度产生了许多问题,如土地矛盾增多,土地流转不畅等。这些问题已经影响到农村的改革、发展和稳定大局。造成这种情况的主要原因在于土地承包经营权的物权性效力残缺、不彻底。为此,本文采用历史研究、文献研究、比较研究、实证研究等多种研究方法,从我国农村土地承包经营权的物权化进程和性质定位入手,系统、深入的分析了土地承包经营权物权性效力残缺的表现形式及所带来的负面影响,提出了具体的建议,并提出了借鉴传统的永佃权内容来构造和完善农村土地承包经营权的思路。论文共分三章。第一章主要通过对农村土地承包经营权有关法规的简要回顾,来论证我国农村土地承包经营权的物权化进程,最终因《物权法》的颁布实施,农村土地承包经营权被定性为用益物权。这是我们完善土地承包经营权的起点和方向;第二章重点对农村土地承包经营权的物权性效力的残缺性进行了系统、深入的分析和研究,认为残缺性使得土地承包经营权在生成、稳定、流转、收益等方面产生了诸多问题,并针对问题提出了具体建议;第三章通过权利层面的比较分析,认为有必要借鉴传统永佃权来构造和完善现行土地承包经营权,并论证了构造和完善的可行性。更多还原

【Abstract】 Land as a natural resource and social wealth, is famers’ conditions for survival and important social security. The implementation of the Land Contract and Operating System which based on the household contract responsibility system, has stimulated china’s hundreds of millions of famers’ enthusiasm, and improved rural productivity, promoted the development of rural economy .However ,in the new historical stage ,with the deepening of reform and opening up and the accelerated process of agricultural industrialization ,the Land Contract and Operating System that have played an important role in history have a lot of problem now, such as conflicts increasing ,land circulation obstructed, which has influnced the reform ,development and stability of the rural area. The main reason for this is that the effect of property right of Land Contract and operating right is incomplete .So, at the stat point of the course of china’s the Land Contract and Operating Right and stipulated for property right ,the author analyzed deeply and systematically the appearances and bad results of deterioration of property right of the Land Contract and Operating Right, and also put forward some suggestions to perfect the Land Contract and Operating Right by using some content of the traditional permanent tenancy right for reference , using variety methods of study , such as historical study, documental study, comparative study and positivist study, etc.The thesis is divided into three chapters . the first chapter review the relevant laws and regulations of the Land Contract and Operating Right, to demonstrate the course of china’s the Land Contract and Operating Right for the operation of the property right. In October 2007, <property right law> was promulgated and carried out, the Land Contract and Operating Right was stipulated as beneficial property right, this is our starting point and direction of perfection of the Land Contract and Operating Right. Chapter two make a deep analysis of the deterioration of the effectiveness of the Land Contract and Operating Right, and indicate that the deterioration of Land Contract and Operating Right have generated many issues in formation ,stability ,circulation ,and give perfect views referring to these problems. Chapter three, after careful comparative analysis of different views of perfecting the Land Contract and Operating Right.,it is necessary to make reference to the traditional permanent tenancy right to perfect Land Contract and Operating Right on the basis of analyzing the realistic foundation .更多还原
