【摘要】 随着我国电信改革的深入和市场竞争的加剧,我国电信互联互通中的网间结算制度的局限性越来越明显,各运营商间的争论和矛盾越来越大,现有的网间结算制度已经不适应我国电信业的发展。本文在阐述网间结算涉及到的法律关系后,对每种法律关系中的主体、客体和权利义务进行分析,并从法的利益平衡原则的法理依据出发主张电信网间结算以成本为基础的原则,即以成本为基础的网间结算原则和结算方式可以平衡运营商间的利益、运营商和大众消费者的利益、国家规制与竞争的关系。但在实践中,我国的很多规定和做法却背离了这个原则,有必要对网间结算进行系统的规制,笔者针对我国的网间结算的存在的问题,结合我国的实际情况提出系统的法律解决方案,首先是主张制定电信行业的基本法《电信法》,并在其中明确规定以成本为基础的网间结算原则;其次,确立网间结算制度的目的和宗旨。再次,阐述确定具体网间结算方式时注重考虑历史的因素,采取反映历史成本的结算方式;最后,完善其他制度来促进以成本原则的实现。更多还原

【Abstract】 Along with the deepening of the reform and the increasing competition of telecom market, the limitations between China’s interconnection charges system has become more and more obvious. The fact that more and more controversy and contradictions happening between telecommunication operators has shown that the system of interconnection charges no longer meet the development of China’s telecommunications industry.In this paper, the legal relationships refer to the interconnection charges are expatiated, and then the analysis expands to the subject, object and rights and duties in every legal relationship of the whole legal system. Also, according to the principle of law projected an on view in which the interconnection charges of telecom should be cost-based, And this principal strikes a good interest balance between operators, operator and the community and the sate regulation and competition.However, when comes to the actualizing, the principals are often deviated from, It is necessary to carry out a systematic settlement on interconnection charges system, After analyzing the problems of interconnection charges, a systematic solutions has been projected in this paper, First of all, an authoritative basic law "Telecommunications Act" is proposed to be legislated in which the cost-based interconnection charges principal is clearly expatiated; Secondly, the object and purpose of the interconnection charges settlement system should be established; And the third, historical cost method of settlement should be reflected, namely, the historical factors should be seriously considered in the specific interconnection charges affairs; Finally, perfect other related system to promote the realization of other cost principles.更多还原
