银行服务消费者权益保护若干问题研究

【摘要】 本文首先立足于对银行服务相对人法律地位的分析,在反思当前消费者权益保护理论的基础上阐述了将银行服务个体相对人界定为消费者的必要性,提出在银行服务相对人保护过程中应引入消费者权益保护理论,从而为银行服务相对人权益保护提供一个完整的理论基础和应然权利体系。同时,本文结合对消费者权益保护与金融安全维护的辨证分析,合理界定了银行服务消费者权益保护手段的适度性。基于银行服务的特殊性,文章针对当前消费者权益保护法不能很好解决的银行对其服务对象的选择与歧视、银行对其所提供的金融产品与服务的信息披露等特殊问题加以具体分析;提出了银行在基本账户提供、贷款支持等方面应负有更多的金融包容义务,立法应在银行信息披露的内容、对象和程序上有更为科学地界定以消除双方信息不对称等观点。最后,为解决银行服务消费者维权的实际困难,文章认为银行、监管部门和行业协会应当为消费者提供更为便捷的维权途径,并依据各主体在银行服务消费者保护中的不同角色和地位为银行服务消费者权利的实现合理设计便捷经济的模式与程序,合理分配政府监管部门、行业协会组织和金融机构的相关义务,从而在实体和程序上对银行服务消费者加以全面保护。
【Abstract】 On the basis of reflecting the protection theory of consumer’s rights at present, the first part of the paper is the legal status analysis on private party of banking services and the necessity of defining private party of banking services as consumer, then puts forward introducing the protection theory of consumer’s rights. Therefore, a complete theory foundation and natural right system is provided to private party of banking services. Meanwhile, the paper combines differential analysis of the protection of consumer’s rights and the maintenance of financial safety, and reasonably defines the protective means moderation of consumer’s rights in banking services.According to particularities of banking services, the paper aims at these special problems such as selection and discrimination on banking services objects, information disclosure on financial products and services, which can not be solved very well in the legislation protection of current consumer’s rights. So the paper proposes two viewpoints. One is that the bank should bear more liabilities of financial inclusion on the aspects of providing basic account and loan support. Second, the legislation should have more scientifical definition of content, object and procedure in information disclosure of bank, which can eliminate information asymmetry between both sides.Finally, in order to handle practical difficulties of consumer’s right safeguarding in banking services, the paper points out that bank, government and trade association should provide more convenient ways of right safeguarding. Based on main bodies’ different roles and status in the consumer protection of banking services, the legislation should reasonably design a economical pattern and procedure, and distribute obligations of government, trade association and financial institutions, so as to provide entire protection to consumers of banking services in the substance and procedure.
