【摘要】 本文首先强调指出社会保障权是公民的一项基本权利,又阐述了社会保障产生的思想根源、经济根源和以及社会保障权的发展。社会保障权是公民依法享有的要求国家积极提供社会保障的条件和便利,通过社会保障,维持其生存和发展的一项宪法基本权利。社会保障权,是有社会保险权、社会救助权、社会福利权和社会优抚权等子权利所构成的权利体系。社会保障权既是一系列国际法文件确认和保障的一项重要的基本人权,也是大多数国家宪法规定的社会基本权利。社会保障权的保障分为事前保障和事后保障。事前保障包括行政保障和法律保障两方面,事后保障主要为司法救济。最后,本文分析了我国社会保障权利救济制度的现状及存在的问题。以美国、德国社会保障权利救济的相关规定为例,提出了完善我国社会保障权利救济制度的建议。更多还原

【Abstract】 This thesis, firstly, emphasizes to point out that social security is a basic right of the citizens .Elaborating the social security of thought source, economic source and , and the development of social security right really. Right to social security is a basic constitutional right, and it is a basic social right possessed by the citizens. The citizen can request nation by law to provide condition and conveniences of the social security actively. Passing social security ,citizens can maintain their existence and gain development. As a right system, right to social security is constituted by some sub-rights-social insurance right, public relief right, social welfare right and excellent fondle right etc. Right to social security is not only an important and basic human right confirmed and guaranteed by some documents of international law ,but also a basic social right regulated by most Constitutions.The protection of the social security right consists of the protection before the matters and after the matters. The protection before the matters consists of legislative protection and administrative protection .The protection after the matters is mainly the judicial review. The last part has discussed the question of social security right relief from the angle of social security administration opposite party legitimate rights and interests. Uses the comparison the method, has analyzed our country social security right relief system present situation and the existence question, take US, the Germany social security right relief correlation stipulation as the example ,proposed consummates our country social security right relief system the suggestion.更多还原
