【摘要】 本文的目的是在对行政诉讼原告资格进行分析的基础上,提出对其的完善构想。在证过程中,本文采取了历史研究、比较研究、理论与实际相结合的研究方法来对本文的论点进行论证。本文总共分四部分,本文第一部分首先对行政诉讼原告资格的概念与本质及其与其他相关概念之间的区别进行了论证,目的在于先理清行政诉讼原告资格的外延内涵,为后面的论证奠定基础;第二部分回顾了我国行政诉讼原告资格标准的发展历程,并对现今标准进行了分析并对其起到的积极作用进行了肯定;第三部分主要是分析问题,即我国现行行政诉讼原告资格认定标准及原告资格制度存在的问题,并捎带提出了笔者对解决问题的一些想法;第四部分是笔者对行政诉讼原告资格的重构,先是提出了抽象行政诉讼原告资格的立场、方法已经新的思路,接着对微观上要注意的几个问题进行了特别说明,最后提了自己的重构观点。更多还原

【Abstract】 This article goal is to consummate the conception,by carrying on the analysis to the administrative proceedings plaintiff qualifications in the foundation. In the proof process, this article adopted the research techniques, which are the historical studies, the comparison research, the theory and actual unified to come to this article argument to carry on the proof.This article is divided to four parts. the first part first has carried on the proof to the administrative proceedings plaintiff qualifications’ concept and essential and the differences with other related concepts, The goal lies in clearing off the administrative proceedings plaintiff qualifications and laying the foundation for the following proof. The second part reviewed our country administrative proceedings plaintiff qualifications standard development process, and has carried on the analysis to the nowadays standard and its positive role, which enjoys the affirmation. The third part mainly analyzes the question, namely our country present administrative proceedings plaintiff qualifications’ and the plaintiff qualifications system questions, and took along with the author’s proposals to solve those questions. The fourth part is the author’s new idea for administrative proceedings plaintiff qualifications restructuring, proposed the first abstract administrative proceedings plaintiff qualifications’ standpoint, the method of the new mentality, then to several microscopical questions, which must pay attention to, finally proposed author’s restructuring viewpoint.更多还原
