【摘要】 现代法律的主体是成文法,而成文法的适用依赖于法律解释。婚姻关系是社会的基本结构之一,一个家庭的稳定与健康发展关系到社会的稳定与发展。对婚姻家庭关系的的法律调整,涉及男女老幼千家万户的切身利益和社会公共利益。婚姻法是新中国成立后率先颁布的具有基本法性质的法律,由于婚姻法规定的过于原则,所以婚姻法的司法解释对婚姻法的适用意义重大。本文首先从法理上分析了最高人民法院司法解释权的来源,并结合婚姻法司法解释的内容和制定,对婚姻法司法解释的合法性进行了论证,指出婚姻法司法解释无论从其制定主体、程序、内容上看,都是合法、正当的。第二部分对我国现行的婚姻法和婚姻法司法解释的基本内容进行了论述,对婚姻法司法解释的主要内容进行了分析和阐述。第三部分对婚姻法司法解释的重要意义和在实践中起到巨大作用,结合实例有针对性的进行了论证,应该说婚姻法司法解释对明确婚姻法的界限、填补婚姻法的空白、弥补法律漏洞起到了很大作用,对婚姻法的完善与发展意义重大。第四部分重点从婚姻法司法解释的制定主体、制定程序、制定内容等角度,分析了婚姻法司法解释的存在问题,并有针对性的提出了需要进一步强化婚姻法司法解释在实施婚姻法中的地位,充分发挥其作用,并应当从明确司法解释的范围和效力等级对婚姻法的司法解释加以规范和明确,以及确立公开解释原则对存在缺陷的司法解释进行清理和救济。文章最后是结论,婚姻法的实施依赖于婚姻法的司法解释,婚姻法的司法解释的不断完善必将大大推动我国婚姻法的发展,大大促进和谐美满的婚姻家庭关系的构建。更多还原

【Abstract】 The subject of the modern law is a written law, and the application of written law depends on judicial explanation. The marriage relation is one of the basic structures of the society, and stability and sound development of a family concerns the stability and development of the society. The legal adjustment of marriage relation relates to the vital interests and the social public interests of huge numbers of every family. Because of marriage laws too principle stipulation, the judicial interpretation of marriage means great to application of law of marriage. This article analyzes the source of the judicial interpretation right of the Supreme People’s Court firstly, and proves the legitimacy of judicial explanation of marriage law, combining content and formulation of judicial explanation of marriage law. It concludes that the marriage law judicial explanation is legal and proper from its formulation main body, the procedure, and the content. The second part analyzes and explains the main content of judicial explanation of marriage law, and describes the marriage law current to our country and basic content of marriage law judicial explanation. The third part proves that judicial explanation of marriage law is important meaning and playing an enormous role in practice, combining the pointed proving of embodiment. The judicial explanation of marriage law is to defining the demarcation line of the marriage law, filling in the blank of the marriage law, remedying the legal loophole and it means great to completion and developing of the marriage law. Part four analyzes the problem of judicial explanation of marriage law from the formulation subject, making angles such as the procedure, making the content. It needs further strengthening the position of the marriage law in implementing the marriage law of judicial explanation, and render a service grade judicial explanation in marriage law to define judicial explanation, and clear up and relieve the defect of judicial explanation with establishing disclosing and explaining principle. The end of article is a conclusion, the implementation of the marriage law depends on the judicial explanation of the marriage law, the constant completion of judicial explanation of the marriage law will promote the development of marriage law of our country greatly, promote the construction of the harmonious and happy marriage family relationship greatly.更多还原
