【摘要】 本文探讨的是一种新兴的公众权利,即公众环境公益诉权。从公众环境公益诉权的属性可知,它是一种保护环境的公权利,是一种以保护公共利益为目的的权利,是一种从属于环境公权力的权利。随着环境的日益恶化,政府独自治理环境的失灵,公众的环境意识和民主意识被激发出来了,诉权理论也有了进一步的发展,基于此,我国已经具备了确立公众环境公益诉权的条件。而后,笔者在介绍和借鉴了美国、英国、德国、印度、日本等国公众环境公益诉权主体的基础上,认为我国公众环境公益诉权的主体包括普通民众、环保NGO和公益律师。另外,在分析公众环境公益诉权的如何行使的基础上,探讨了有关我国公众环境公益诉权行使条件的若干具体问题,主要是诉求的范围、受理案件的法院或法庭的明确、诉讼费用的创新、诉讼时效与举证责任的改革、建立法律援助机制和提高公众行使环境公益诉权的意识。更多还原

【Abstract】 This article discusses is one kind of emerging public rights,namely public environment public welfare right of suit. We may know from public environment public welfare right of suit’s attribute,it is one kind of protective environment public rights、it is one kind of rights to protects the public interests, and also one kind rights which belongs to the environment civil rights. Along with environment day-by-day worsening, the government alone governed the environment was malfunction, Public’s environmental awareness and the democratic awareness were stimulated, the right of suit theory also had the further development. Based on these,our country had already met the establishment public environment public welfare right of suit requirement. Then, after introducing and profiting US, Britain, Germany, India, Japan‘s public environment public welfare right of suit, the author thinks the main body in our country public environment public welfare right of suit including ordinary populace、environmental protection organization and public welfare attorney. Moreover, based on analyzing the exercises of the public environment public welfare right of suit,this article has discussed our country’s public environment public welfare right of suit exercises generic condition certain concrete questions, which mainly including demand scope, accepts case’s court or the court explicitly、the innovation of itigation expense、reform the limitation of action and the responsibility of provides the evidence、the establishment of legal help mechanism and enhances the populace’s consciousness to exercise the environment public welfare right of suit。更多还原
