城市物业管理中的合作机制与制度安排
On the Cooperative Mechanism and Institutional Arrangement in the Urban Property Management

【摘要】 我国内地的物业管理从20世纪80年代初起步,经过20多年的发展,今天已经发展成为一个拥有3万多家企业,250多万从业人员的新产业。然而,伴随着物业管理业的蓬勃发展,包含业主、物业服务企业、开发商、地方政府和社区居委会在内的利益主体间一直纠纷不断。尤其是业主与物业企业之间经常发生矛盾,这种矛盾有时表现为彼此间的不合作或消极抵抗,有时则上升成直接的利益冲突和利益纠纷。利益冲突形成的原因或许很多。当参与者在参与过程中未能有效配合与合作时,相互间的指责甚至误会都会引起参与者之间的矛盾和冲突,各自的利益也难以得到保障。本文试图在兼顾各方利益前提下从合作的角度来研究我国城市物业管理中的各个利益主体间的合作机制及制度安排。文章共分五个部分。第一部分简要介绍了研究背景、研究思路、研究方法和研究内容,回顾了关于城市物业管理的国内外研究动态。第二部分介绍了研究的理论基础,主要阐述理性经济人理论、合作理论和博弈论。第三部分是物业管理中各参与主体间的合作形态及合作现状分析。第四部分构建了物业服务企业与业主在物业管理费收费过程中的完全静态信息模型。第五部分重点阐述了促进物业管理利益主体间合作的各种制度安排。包括建立业主委员激励机制、物业招投标机制以及从中国传统文化视角探寻一种有效的文化约束。文章认为,影响了中国人民几千年的传统文化对于维系社会成员的合作状态具有不可估量的作用。
【Abstract】 By the 20 years development,the property management industry achieved tremendous accomplishments in China.At the moment,the industry has more than 30000 enterprises today,above 25000000 employees.Along with the booming development of the property management industry,there are some conflicts between the property developer,property service enterprise,owner,local authority and residents’ committee, especially the conflict of interests between the property owner and the property service enterprise.There are many reasons for the conflict of interests.When the participants failed to achieve effective coordination and cooperation,the recriminations and misunderstanding between them would cause the conflict.Then their interests can not be guaranteed.This paper attempts to research the institutional arrangements from the perspective of the cooperative mechanism among the property management participants.There are five parts in this paper.In the first chapter,the background,research content,structure and research method of paper are introduced.In the chapter,author also reviewed the literature about property management in china and abroad in detail.The second chapter introduces basic theory,especially about the theory of the rational economic man,cooperation,and game theory.Then in the third chapter,it analyzes the status and problems in cooperation of all the property management participants.In the forth chapter,with the aid of game theory,static game of complete information in the property management charge process between property services enterprise and the property owner is briefly analyzed.The chapter V presents some advice about how to realize the cooperation among the property management participants.The traditional Chinese culture,which has nourished and cultivated the Chinese people for several thousand years,will have great help on the property management.Then a brief conclusion is presented in the last chapter.
