【摘要】 建筑业作为国民经济各部门物质基础的重要来源,对整个国民经济的发展起着举足轻重的作用。但目前的建设方主动的建筑市场,使承包方处在一种不平等的地位。在授予合同阶段,业主方单方面编写招标文件,单方面拟定合同款,导致合同条款不平等;在工程实施阶段,从工程款的支付、工程的变更、工程的索赔、工程的验收及交付、到工程审计都存在诸多的不平等现象。而实际上,无论是从法律的平等主体的角度还是从经济学原理的角度来看,二者都应该是平等的。通过理论的研究,尤其是通过对公平与效益理论的研究,可以清醒地意识到,承包商在工程实践中的不平等地位必将是对健康有序经济市场的破坏,改革势在必行。首先应从承包商的自身素质的提高开始,其次通过组建行业协会,共同对抗不平等,再者,政府应该加强监管,从而实现对建筑业各方的有效约束,确保承包商的平等地位。更多还原

【Abstract】 As an important material resource of all sectors of national economy, construction industry plays a significant role in national economy’s development. But in present building market, the contractors are unequal status. In granting contracts stage, compiling the bidding documents and drawing up contract clauses by employer unilaterally causes the contract provisions not to be fair. In project implementation stage, there are so many unequal senses in project funds payment, project modification, project compensation, project audit and other some aspects. In fact, looked from legal body in law or the principle of economics, both proprietors and contractors should be equal. Based research on upper theories, especially equality and benefit theory, it can be obviously found that the passive position of contractors in project must do harm to the healthful order of market economy. So innovation is imperative. Improving the contractor’s own character, creating industry association to handle the unfair dealing, strengthening government control and management, carrying out these measures could restrain all aspects in building industry and ensure equality to contractors.更多还原
