【摘要】 随着改革开放的深入发展和社会主义市场经济体制的逐步建立，我国的政治、经济和社会心理都已发生了巨大的变化。政府管理行为日益注重效益、效率、经济和公平。在刑罚执行领域，我国传统的行刑思想和监狱的行刑机制已经难以适应新的情况：对罪犯过于注重监禁刑的适用，与现代行刑目的相背离；过于强调劳动改造手段的使用，阻碍了其他教育手段的使用；而我国监企合一的监狱管理体制在监狱经济发生严重困难的情况下，对我国监狱的执法行刑产生了严重干扰，侵蚀和损害了执法的公平与正义。针对此种情况，我国政府于2003年开始对监狱管理体制进行试验性改革：在监狱基本经费由国家财政全额保障的基础上，实行“监企分开”和“收支分开”，将监狱的执法活动与经营活动分离开来，以促进执法的公平与正义，实现监狱职能的单一化。但是，这不应该是此次改革的全部，我国还应顺应世界行刑的历史潮流，采用新的行刑理念和教育矫正措施，继续推进监狱管理的现代化，积极推动行刑社会化的工作。这样，既能提高我国对罪犯的教育矫正效果，又能有效降低刑罚执行的资源消耗，从而能够更好的实现刑罚执行管理改革的目标，为我国现代化建设提供坚强有力的司法保障。更多还原

【Abstract】 With deep development of reform, opening, and socialist market economy, China’s politic, economic and society have already been changed extremely. Now the activities of governmental management pay much more attention to effectiveness, efficiency, economy and fairness. As it is to say in execution, in China, traditional thought and mechanism of prison have not adapted for new situation yet. As far as the prisoners are concerned, emphasis on labor reform that hampered the use of other means of education. The managerial model of combination with prisons and enterprises, which has already damaged to the basis of fair and integrity of execution on the circumstances of bad hardships of prison economics. In response to this situation, China’s government began to reform the prison administration system in 2003. On the basis of whole financial support of major prison expenditure, the aims are to make "depart from income and expense", and make the functions of prison simple, in order to separate execution activity from operation activity.However, those are not all of the reform of prison. China should also follow the trend of world execution, absorb the new ideas of execution and fresh measures of education; China should also continue to improve the modernization of prison management. Like this, it will not only produce positive efficiency of prison education, but also effectively reduce the expense of execution. Therefore, our goal of prison reform will be carried out, and then it will make good service to the national modernization construction.更多还原
