【摘要】 随着我国经济的高速发展和城市化进程的加快，城市改造、房地产开发在各城市轰轰烈烈的展开，而上述目标大都通过我国特有的城市房屋拆迁制度进行。面对大规模的城市“圈地风”，房屋拆迁纠纷日益增多，已成为群众信访反映的焦点之一。因为城市房屋拆迁涉及到诸多重大利益冲突：被拆迁人的大宗财产——房屋、城市发展的急迫需要、开发商的利润等等。这些矛盾越演越烈，出现了一些恶性案件，南京拆迁户自焚的黑烟尚未熄灭，北京天安门广场上又燃起了熊熊的火焰。这些恶性事件引起了社会的强烈的反响，人们特别是被拆迁人纷纷质疑我国房屋拆迁补偿制度的合法性。那么，拆迁户怎样维护自己的合法的财产权和生存权?当前城市拆迁矛盾冲突的深层根源和实质是什么?如何解决城市拆迁之痛?如何解决拆迁中最棘手的拆迁补偿问题呢?本文将从实证主义的角度探讨城市房屋拆迁中的补偿问题。本文分三部分，第一部分属于导论部分，引出研究论题。介绍城市房屋拆迁补偿制度的基本理论，包括城市房屋拆迁补偿制度的法律性质、补偿的标准及补偿的对象和范围，还包括城市房屋拆迁补偿的形式。第二部分是本论部分，介绍我国城市房屋拆迁补偿制度，主要包括城市房屋拆迁补偿制度的历史沿革，拆迁补偿制度的缺陷及其产生的原因，还包括域外城市房屋拆迁制度对我国的借鉴。第三部分是结论部分，讨论了完善我国城市房屋拆迁补偿制度的途径。在该结论部分我主张：面对城市房屋拆迁补偿制度存在缺陷，我们应该从程序上、实体上和权利救济途径上进行进一步完善，建立公平、公正、合理的拆迁补偿制度。更多还原
