【Abstract】 Starting from the analysis of existing problems of the two-trial-for-final trial system of this country, this essay specifies the necessity of establishing the "third trial for legal issue", proposes the improvement of two-trial-for-final system and the construction of limited three-trial-for-final system, probes into the distinction of "factual issue" and "legal issue" which is brought out by the trial for legal issue. It points out, meanwhile, that it requires to establish the related ideas and to link up with matching systems in order to realize the goals of the "third trial for legal issue".更多还原
