法制教育与道德教育若干问题比较研究

【摘要】 依法治国与以德治国是我国的治国方略,实施这两个治国方略,必须对公民加强法制教育和道德教育,以提高全民族的法律意识和道德水平。虽然学术界及理论界对法制教育及道德教育的专项研究已取得丰硕成果,开展法制教育与道德教育的比较研究仍具有极其重要的意义,这有助于进一步分析法制教育和道德教育各自的特点及规律,能增强相应教育的针对性及实效性,克服其盲目性。 本文运用理论分析方法、横向比较方法及理论联系实际法,从不同角度深入剖析法制教育与道德教育的同质性及异质性。 从研究对象来看,本文以法制教育与道德教育为研究对象。文章首先对法制及道德的概念进行简要概括,并对法制教育及道德教育进行界定,进而分析了法制教育与道德教育之间的联系。从研究内容来看,文章从法制教育与道德教育的目的、作用、遵循的原则、包含的内容、开展的途径与方法等基本方面进行具体的比较分析,探讨了法制教育与道德教育各自的特点与具体内容;在对每一部分进行比较之后,还进行了相应的小结,以进一步揭示它们之间的联系和区别。 这种比较研究与其它相关的单项专题性的研究不同。无论是法制教育还是道德教育的专题性研究大多是对其本身的考察研究,较少展开比较研究。没有比较就没有鉴别,只有在联系中和比较中,才能区分其基本属性及特征,从而把握其特定的质。本文通过对法制教育与道德教育主要方面的比较研究,可以看到,法制教育与道德教育各有其特定的含义,有其相对独立存在的合理性与不可取代性,而且相互之间,还具有互容并包、彼此促进、统一生效的内在联系。

【Abstract】 The rule of law and the rule of morality are China’s state policies. We have to strengthen legal education and moral cultivation in order to improve legal awareness and moral level of our whole nation by carrying out the two policies.Though academe and theory circle have achieved a lot of fruits in some specific research, the comparative research between legal education and moral cultivation is quite significant, which can further analyse their respective characteristics and principles, better their pertinence and actual effect, and overcome blindness.The thesis employs method of theoretical analysis, method of horizontal comparison and method of theory associated with practice, deeply analyzes homogeneity and heterogeneity between legal education and moral education from different angles.From the point of research object, the thesis takes legal education and moral cultivation as the research objects. It briefly summarizes about the concept of legal education and moral cultivation and makes a definition about them, and then analyses the relation between them. From the point of research content, it makes comparative analysis about their purpose, functions, contents, the approaches and methods, discusses their respective characteristics and specific contents. The author also makes a corresponding summary after comparing them in each aspect to reveal the association and difference between them.The comparative research is different from the research in special topic. No matter what it is the special topic research about legal education or moral cultivation, it is the research about itself. People seldom make comparative research about it. We cannot distinguish without comparison. People can only distinguish their basic properties and characteristics in association and comparison. The article illustrates that legal and moral education have their respective signification through the comparative research between them. It is reasonable for them to exist relatively independently and they cannot be replaced with each other. Meanwhile, they involve each other, promote each other and come into force together.
