【摘要】 本文从预售商品房按揭的本质和实际情况出发，对我国预售商品房按揭制度进行了研究。全文共分为四个部分，在介绍了按揭的起源及预售商品房按揭制度在我国的发展情况后，系统地阐述了预售商品房按揭的法律属性、预售商品房按揭中常见风险的法律防范及控制、完善我国预售商品房按揭制度方面的内容，明确了以购房人、贷款银行、开发商三方为主体的预售商品房按揭的法律特征及其涉及的法律关系，并且对预售商品房按揭中存在的风险进行了概括，从保险业的介入、住房抵押贷款证券化的实行、开发商的担保和中介机构的参与等四方面提出了风险防范措施，在分析了我国预售商品房按揭制度的立法现状后，提出了完善现有的《商品房预售管理办法》和制定《预售商品房按揭管理办法》等两项措施。预售商品房按揭的出现不仅缓解了房地产市场开发资金紧张的状况，也为广大普通百姓拥有属于自己的商品房提供了良好的条件，同时也拓展了银行的业务，扩大了房地产的销售市场。本文意在通过对预售商品房按揭制度的研究，为完善我国预售商品房按揭制度尽自己的微薄之力。更多还原

【Abstract】 In terms of the nature and the actual conditions of the commodity-housings presale mortgage , the author makes a rather systematic study on the system of national commodity-housings presale mortgage from four aspects. After introducing the origin of mortgage and the development of the system of national commodity-housings presale mortgage, the thesis discusses the legal characteristic and the most essential risks of the commodity-housings presale mortgage, defines the legal characteristic of the subject which is composed of the consume, the bank and the real estate development enterprises, summarizes the risks that come form the subject, indicates four precaution methods about the risks, which are the insurance intervention, the securitization of housing mortgage loan, the guarantee of the real estate development enterprises and the joining of medi-organization, and proposes to perfect the Commodity-housings Presale Management Law and constitute the Commodity -housings Presale Mortgage Management Law after analyzing the actual legislation conditions about the system of national commodity-housings presale mortgage. The appearance of the commodity-housings presale mortgage is not only settling the real estate development financing but also providing the better conditions for common people to purchase commodity-housings. At the same time, it increases the bank operations and enlarges the real estate market.
