【摘要】 农业无形资产是无形资产的重要组成部分。随着知识经济时代的临近，农业无形资产逐渐成为农业持续、快速、高效发展的主要经济资源。然而，在我国，农业无形资产保护意识淡薄，保护措施不力，致使农业无形资产流失严重。如何保护农业无形资产是当前亟待需研究的问题。 本文从农业无形资产的基本问题入手，采用比较分析研究法、定性分析与定量分析法以及理论分析与实际结合的方法，首先阐释了农业无形资产、无形资产和知识产权的本质特征，揭示三者之间固有的内在联系，接着诠释了农业无形资产法律保护的理论依据和社会法律基础，然后详细研究国外知识产权立法现状，确定农业无形资产法律保护可借鉴的法律条款，同时分析了我国农业无形资产保护中存在的问题及其深层原因，在此基础上架构农业企事业单位管理无形资产的机构与制度，最后，针对不同类型的农业无形资产的特殊性，运用知识产权法律制度提出农业无形资产法律保护的对策与策略。更多还原

【Abstract】 Agricultural intangible assets (AIS) is the main part of intangible assets. With the coming of Knowledge economy era, AIS gradually becomes the major economy resource for the sustained, rapid and efficient development of agriculture. However, the protection sense for AIS becomes indifferent in our country, and protection measure is powerless with the result that AIS is run off seriously. How to protect AIS is a urgent problem to study.Beginning with the fundamental problem of AIS, this paper uses the comparative analysis studying method, qualitative analysis and quantitative analysis method, and the combination method of theory analysis with practical application. Firstly, it sets forth the essential feature of AIS, 1A and IP, reveals the inherent relation within them, then explains the theory foundation and social law base of the AIS law protection. Secondly, it studies in detail the present legislative situation of IP at home and abroad making clear the law clause to AIS protection for reference in our country, and analyzing the extant problem and deep reasons in AIS protection in our country. According to all the above, it makes the institution and system of agricultural business and institution administration. Lastly, according to the different speciality of AIS, it apples the IP law system to push forward the tactics and countermeasure of AIS law protection.更多还原
