【摘要】 科学技术已成为第一生产力。科技创新和文学艺术的进步对人们的生产、生活产生积极的影响。知识产权制度与科学技术及文学艺术有着特殊的联系。公平合理、先进的知识产权法律制度会极大地促进科技文化的发展，落后的知识产权法律制度则会阻碍科技文化的发展。随着经济全球化进程的不断加快，经济的发展与科技、法律密切相联。知识产权的竞争日益激烈，侵犯知识产权的现象也越来越多。我国的知识产权制度与世界上发达国家相比，对知识产权的保护程度上仍有相当的差距。在我国，对知识产权侵权行为的概念、归责原则还没有统一认识。现行的侵害知识产权民事责任制度不足以对权利人权利的保护，不足以有效遏制知识产权侵权现象。我国在知识产权侵权民事责任制度方面的立法还不完善。本文试从侵犯知识产权行为的认定，侵犯知识产权民事责任、归责原则等方面进行探讨，以不断完善我国的侵害知识产权民事责任制度，加强对知识产权的保护。更多还原

【Abstract】 Science and technology is the first productive forces. It can produce a great influence upon people’ s produce and life. Intellectual property institution is connected with science, technology, culture and art. The fair intellectual property can make a great development of science and technology. The backward will block the development. With the development of economy continued and quickly in the world, it is connected with science, technology, culture and law. Infringement upon intellectual property is more and more. The degree of protecting intellectual property in our country is lower than most other countries in the world. There is not the same opinion about the conception, responsibility principle of infringement upon intellectual property. Now, the civil responsibility institution of infringement upon intellectual property cannot protect intellectual property well. It cannot effectively prevent from infringing intellectual property. The law of civil responsibility of infringement upon intellectual property is not perfect. My thesis is about to firmly believe the act, the civil responsibility and responsibility principle of the infringement upon intellectual property.The aim of my thesis is that the civil responsibility institution of infringement upon intellectual property will be continually perfect and the measures of protecting intellectual property will be perfect and strengthened.更多还原
