【摘要】 本文通过中小学依法治校这一课题的研究，明确中小学依法治校的意义、存在的问题及对策，为众多的中小学工作者在教育、教学、管理过程中依法办事和从事教育法学研究的工作者提供参考，真正实现从理想到现实的依法治校，推动科教兴国战略的实施和依法治国方略的实现。 本文所采用的研究方法主要有文献分析法、访谈调查法、比较研究法、归纳法。每一种方法不是单独被采用，而是综合交错展开的。同时又根据论题需要有侧重选择一种方法或几种方法相互补充进行研究。 本文主要内容分六部分。 第一部分“中小学依法治校的主体定位、本质含义及基本内容”。 第二部分“中小学依法治校的意义”。具体阐述了中小学依法治校对国家实施依法治国、巩固“两基”进一步推行义务教育、推动教育事业发展、提高综合国力及对中小学自身发展建设等方面的意义。 第三部分“中小学依法治校的理论依据”，从管理学、政治学、教育学、教育法学、社会学、心理学等学科角度阐述中小学依法治校必然性。 第四部分“中小学依法治校的历史沿革”，阐述了中外各国依法管理中小学的历史经验。 第五部分“我国中小学依法治校的现状”，简述我国中小学在依法治校方面所取得的成绩和主要论述中小学在依法治校方面存在的问题及原因。 第六部分“中小学依法治校的对策”。根据中小学依法治校存在问题的内外因从健全教育法规、严格教育执法、加强教育执法监督和学校自身的法制建设等几方面提出解决问题的对策。更多还原

【Abstract】 By the means of research into managementof middle and primary schools complying with law,the essay clarifes the significance, existence problem and countermeasures for managing schoos complying with law with the purpose of providing reference to the numerous teaching staff during their inculcating, teaching and management complying with law, realizes managing schools complying with law, promote the strategy of prospering nation with science and education, and realize the management of state affairs with law.The methods of the research includes literature analyse,interview, comparison, and induction. These methods are used together but not individually. Meantime, As the request of the research, one or two methods are used mainly.There are six parts in the paper.Firstly, "principal orientation, inbeing meanings and basic contents of managing middle and primary schools complying with law".Secondly, "significance for managing middle and primary schools complying with law".The significance of the "managing schools complying with law" to managing state affairs complying with law, to consolidating "two fundamental principles" further pushing compulsory education, to promoting education project ,to improving synthesis national power, and to middle and primary schools’ self development and self construction, is conceretly stated.Thirdly, "theoretical basis for managing middle and primary schools complying with law" is presented. The paper sets forth the inevitability formanaging schools complying with law under the theory of management, politics, education,sociology, psychology, etc.Fourthly, "the previous evolution for managing middle and primary schools complying with law",and the previous experience of china and foreign countries of this aspect are stated.Fifthly, "status quo of the manage middle and primary school complying with law in our country", briefly describe the achievement of manage complying with law, and mainly expound the present problems and reason of managing school complying with law.Sixthly, "the strategy for managing middle and primary schools complying with law".
