【摘要】 动产抵押作为一种新兴的担保方式，在担保物权中独占鳌头。它以独特的公示方式打破了传统物权变动的和谐完美的体系，似乎是两种物权体系冲撞之处砰出的理性火花。动产抵押制度的创设，扩充了动产的用益及担保功能，对于市场经济的发展具有重大意义。本文主要对动产抵押的公示方式，动产抵押权的效力，动产抵押登记的公信力以及抵押物的转让等问题进行了探讨。对于动产抵押的公示方式，书面成立．登记对抗主义颇为一种良好之方式。动产抵押权的成立，不以登记为要件，只须当事人订立抵押契约即可生效。经登记之动产抵押权具有对抗效力，但也有例外。动产物权变动以交付占有为公示方式，登记只是为弥补动产抵押因欠缺公示而采取的变通措施，登记只具有公示力，而不具有公信力。动产抵押物的转让导致了两种利益的冲突，化解这一冲突的最好方法便是采取抵押权的物上代位性。同时，基于保护交易安全，维护抵押权的需要，应承认动产抵押权的善意取得，这也表明善意取得制度在发展中不断壮大。更多还原

【Abstract】 Mortgage of chattel is a burgeoning means of guarantee which plays a predominant role in the mortgage. Its uniqueness of demonstration had broken the traditional transfer of property; although which had a harmonious system. It seems that rational sparkle could stem from the conflicts between two real property system. The establishment of mortgage of chattel has expanded the rights of use and functions of guarantee in chattels, which meant a great importance for market economy . This paper has a great insight to the demonstration of chattels, to the effect of mortgage , to the convincingness of registration and transfer of mortgage of chattels. As for the demonstration of mortgage of chattels, this paper argues that registration is a good means for the doctrine of confrontation. The establishment of mortgage of chattels does not depend on registration, but on the mutual agreement between parties. By the means of registration, the chattel has a confrontation effect; but there is also an exception. The transfer of chattel takes possession as its demonstration, which has a confrontation effect but for convincingness, the transfer of chattel causes conflicts, the best solution to it is the surrogation of thing. Meanwhile based on protecting security of transaction and safeguarding the right of mortgage, it should be admitted that the system of acquisition of movable property in good faith should be used to mortgage of chattels, which manifests the increasing improvement in that principle.更多还原
