论我国检察监督制度

【摘要】 我国检察监督制度是关于检察机关专门行使国家法律监督权的法律制度，它是一项被我国宪法确认的国家基本法律制度，也是我国政治制度的重要组成部分。本文从检察监督制度的基本理论、检察监督制度的形成、检察监督制度内容及特点、检察监督制度的完善等四个方面进行论述，从而提出这样的法律理论：在我国逐步走向法治的今天，坚持全国人民代表大会制度下的一府两院制度，完善一府两院之间的分工制约关系，改革检察监督领导体制，完善检察机关法律监督的权能，是完善我国检察监督制度的法律基础。全文共分四章。约31000字。 第一章从检察监督制度的概念、基本特征、应遵循的原则、目的与任务等方面论述检察监督制度的基本理论。 第二章论述检察监督制度的形成。简要地介绍法律监督权产生的历史背景、苏联检察长监督制度及我国检察制度的成因。 第三章从我国检察监督制度的内容及其特点等方面论述我国的检察监督制度。 第四章指出我国检察监督制度的缺陷，提出完善我国现行检察监督制度的构想。更多还原

【Abstract】 The procuratorial supervision system is legal system that procuratorial institution special executives national legal supervision power. It is a national basic the basic theory and historical development course of procurtorial supervision system , the procuratorial supervision system of our country, the consummation of the procuratorial supervision system of our country, points out such legal theory: Today, Ruling Nation by Law is a basic method of our nation. Sticking to the system of "government together with two institutions" which is led under the National People’s Congress, consummating the relation of checks and balances among "government together with two institution" is the legal basic that consummates the procuratorial supervision system of our country. The article is divided into four parts, which makes with 29000words.The first part discusses procuratorial supervision system basic theory, which divided into four parts, includes the concept, basic distinguishing features, principium, target ant duty of procuratorial supervision system. The second part discusses the production and development of procuratorial supervision system, introduces the forming background and development of legal supervision power, introduces formation, content,distinguishing features of former Soveit Union Chief procurator supervision system.The third part discusses the forming, content, the distinguishing features of the procutorial supervision system of our country.The 4^th part points out the limitation of the procutorial supervision systemof our country, offers the imagination that consumates the procutorialsupervision system of our country.更多还原
