论道路交通事故损害赔偿责任

【摘要】 我国关于道路交通事故损害赔偿责任的立法仍不够完善，有关道路交通事故损害赔偿责任的全国性立法以及全国性立法与地方性立法之间存在着矛盾。应制定独立、统一的《道路交通事故损害赔偿法》，对于道路交通事故损害赔偿的归责原则、构成要件、责任主体、过失相抵、赔偿程序、赔偿范围和标准作出统一规定。对于道路交通事故损害赔偿责任的归责原则的适用，应区分特殊道路交通事故与一般道路交通事故，对于特殊道路交通侵权行为适用无过错责任原则，对于一般道路交通侵权行为适用过错责任原则，强化对高度危险作业受害者的法律保护。更多还原

【Abstract】 The legislation on the liability for damages for traffic accident needs to be perfected in China. The national legislation contradicts with the local legislation in this aspect. We should enact dependent united "Law on Damages for Traffic Accident",and in this law stipulate the following uniform system:the doctrine of liability fixation constitutive elements liability subjects fault set-off procedure of compensation extent of compensation and standard on damages for traffic accident. It should be separated the special traffic accident from the ordinary one in applying the doctrine of liability fixation on damages for traffic accident,in the special cases,principle of liability without fault needs to be adopted;in the ordinary cases,principle of liability for wrongs needs to be done. So,we should emphasize the protection of the law on the victims of the highly dangerous work.更多还原
