反盗版的对策研究

【摘要】 盗版行为由若干相互联系和相互作用的盗版要素组成的有机整体，是盗版主体通过一定的盗版的途径占有盗版对象而实现盗版的目的。它是历史、出版特权、普通法系的产物。盗版的盛行，扼杀了作者原创精神和创造力；影响了企业的生存；扰乱了正常的市场秩序；破坏了投资环境；使国家税收和就业机会大量减少。中国传统文化心态和思维模式的积淀、科学技术的进步、行政体制的不健全、法律制度的不完善形成了盗版行为的背景。盗版对象经济学意义上的公共物品特征、庞大的需求市场、消费者的纵容和鉴别能力的局限、盗版的暴力丰厚的利益回报，是盗版行为的动力。满足病态的心理、实现扭曲的价值观、追求奢华的物欲、实现罪恶的目的等，成为盗版的目的。反盗版的对策有：打击盗版者、截断盗版途径、增强反盗版能力、削弱经济利益、纠正价值偏差。更多还原

【Abstract】 As an organic whole consisting of a certain number of interrelating and interacting elements, "the piracy" can be defined as an information system, in which pirates serve their purpose of piracy by means of possessing the objects of piracy. The piracy is a historical outcome of publication privileges and private ownership. Prevalence of privacy brings about lots of consequences: it smothers an author’s originality and creativity; it jeopardizes the existence of enterprises; it damages the normal market order; it contaminates the investment environment; it decreases the national revenues and employment opportunities; it degenerates the social morality; and finally it lowers the living standards. Traditional Chinese culture and thinking modes, the development of science and technology, the imperfect bureaucratic system , and the incomplete legal system form the supporting system of piracy. The object of piracy having a character of public matter in terms of economics, together with a huge demand market, consumer’s winking and bad discrimination, and tremendous benefit all bring about incentive system of piracy. Satisfying morbid psychology, achieving twisted value, pursuing luxurious physical pleasure, and realizing criminal goals are all the factories composing the purpose system. To eliminate piracy thoroughly, we should make great efforts as follows: punishing pirate, breaking the chains of piracy production, enhancing anti-piracy ability, minimizing pirate’s illegal benefits and rectifying a deviation of pirate’s value.更多还原
