【摘要】 笔者是一位消防工作的从业人员，在学习行政法学的过程中产生了写作这篇论文的创意。笔者通过学习行政法，结合自己的工作体验，体会到行政法学的原理完全适用于消防行政管理工作的整个过程。于是，笔者尝试用行政法的原理去归纳、总结消防行政管理工作，发现消防行政管理工作中具有完善的法律体系作依据，有独立行政主体、行政相对人作条件，有明确的行政行为作结果，完全可以形成一个单独的行政法体系，成为行政法的一个特有领域、一个专门的分支。也就是说，消防行政管理工作完全可以用消防行政法来概括，消防行政管理工作也就是依照消防行政法行使政务的过程。 于是，笔者在本文中，从消防工作法制化的历史演变入手，继而阐述到当代消防工作对法制化建设的需要，以至于到我国消防法规体系的形成及其内容。有了法规体系作基础，那么，进一步就产生了我国消防行政法的概念和范畴。然后，本文通过对消防行政法的作用、基本原则、消防行政主体及其职权、消防行政相对人及其权利和义务、消防行政行为和八种具体消防行政行为等方面问题作出系统研究，发现以上各个方面内容均具备了行政法的基本特征，其概念成立，并构成了消防行政法的各要件，形成了一个我国消防行政法的体系，这个体系贯穿了消防行政管理工作的全部，因而，也就论证了“消防行政管理工作就是依照消防行政法行使政务的过程”的论点。 本文用法律的思路来探索消防管理这个具体的社会问题，率先提出了“消防行政法”的概念，并建立起了一个“消防行政法学”的研究体系，为这个领域的学术研究起了一个抛砖引玉的作用，也为我国消防工作的法制化、正规化、现代化建设起到一定的作用。更多还原

【Abstract】 The author is a man who engages in fire protection. During the process of learning the Administrative Law, I have an idea and write this essay. I think the theory of Administrative Law adapts to the administration management of fire protection. Therefore, the author tries summarizing the administration management of fire protection by using the theory of Administrative Law. Because of its perfect law system, independent administrative law subject and private party in administrative process, and definite administration action, the administration management of fire protection can form separate system of Administrative Law completely and be a special field and a specialized branch of Administrative Law. That is to say, this work can be concluded by the Law. And it is the procedure of performing affairs according to Administration Law.In this essay, the author begins with the development of fire protection legalization, then sets forth the need of contemporary fire protection affairs for the construction of legalization, and finally explains the formation and content of fire protection law system of China. On the base of this law system, the concept and category of fire protection administrative law system come into being. Through studying all aspects (e.g. function, principle, main body and its official powers, fire protection administration affairs etc.)of Fire Protection Law ,the author finds that all these aspects have basis characters of Administrative Law. The concepts and the factors form the system of our administrative law of fire protection. This system runs through administration affairs of fire protection. Hence, it demonstrates the argumentation that administration affair of fire protection is the procedure of performing affairs according to Administrative Law.This essay uses law thoughts to explore fire protection administration?the concrete social problem. It puts forward the concept of Administrative Law of Fire Protection and establishes a research system of Administrative Law of Fire Protection. It has an effect on academic study in this field and on the legalization, normalization and modernization of our fire protection affairs.更多还原
