行政合同若干问题研究

【摘要】 近些年来，行政合同作为推行行政政策的有效手段得到了广泛的应用。同时，正如其他行政行为一样行政合同也需纳入法律调整。 本文首先通过比较西方国家行政合同制度的方式来分析行政合同的特点；接着讨论在中国建构行政合同制度所涉及到的几个特有问题；最后，我将在研究的基础上提出有关行政合同制度建设的理论框架问题，以期为解决实践中存在的问题提供有效途径。更多还原

【Abstract】 Administrative contract has been accepted as effective administrative device to enforce public policy in recent years. At the same time, administrative contract need the adjustment of law as the other administrative actions. To begin with, the author analyzes the trait of administrative contract by way of comparing the administrative contract systems of western countries. Then, the author discusses several special questions in this subject in the RPC. Finally, tbe author proposes a theoretical framework for the construction of administrative contract system in our country.更多还原
