我国农村土地承包经营权流转法律问题研究

【摘要】 土地承包经营权的流转是我国农村经济发展到一定阶段的必然产物。土地承包经营权的合理有序流转不仅能解决我国当前因农民入城而导致的农地抛荒问题,而且能够加快我国农业产业化、规模化进程,推动农村经济结构实现战略性调整。目前,我国的土地流转规模逐年增大,实践中的流转方式也越来越丰富。但是,土地承包经营权的流转毕竟是我国农村在实践家庭联产承包责任制过程中出现的一个新生事物。关于土地承包经营权流转制度的立法也还处于摸索阶段。现有的立法也因种种原因,存在诸多缺陷和不足。而立法的不完善及缺陷已经导致实践中的土地承包经营权流转面临种种法律障碍和现实问题。因此,在农村经济发展的新时期,进一步完善现有的土地承包经营制度,构建科学规范的土地流转制度显得尤为迫切。本文内容共分四章。第一章:阐述了土地承包经营权流转的基础理论,如土地承包经营权的概念、性质、土地承包经营权流转的内涵和土地承包经营权流转的法律特征,该章阐述的基础理论,为作者在后文具体讨论土地承包经营权流转制度打下了理论基础。第二章:阐述了我国土地承包经营权流转的立法演变和现实状况,该章内容的阐述为后文打下了制度和现实基础。第三章:阐述了我国土地承包经营权流转法律制度的缺陷,并重点对立法中的不足和缺陷表达了自己的见解。第四章:根据现有立法的不足,提出了五条完善立法的建议。更多还原

【Abstract】 The land contracting right of management’s circulation is certain stage inevitable product of our country rural economic development. The land contracting right of management’s reasonable and order circulation not can only solve the question of going out of cultivation which caused by farmers entering to the city, but also can speed up our country agriculture’s industrialization and enlargment, impel the rural economic structure to realize the strategic readjustment. At present, our country’s land circulation scale increases year by year, in the practice, the circulation way is also getting more and more rich. But, the land contracting right of management’s circulation is a newly emerging things which appears in the practice of family joint production contract management system process. It is also at the fumble stage about the land contracting right of management circulation system’s legislation. The existing legislation has many flaws and the insufficiency for various reasons. But legislated imperfect and the flaw already caused all sorts of legal impediment and the realistic question in the practice which the land contracting right of management circulation faced with. Therefore, in rural economic development’s new time, further consummating the existing land contracting management system, the construction scientific standard land circulation system appears especially urgent. This article’s content is divided into four chapters. The first chapter elaborated with emphasis the land contracting right of management circulation’s basic theory, like the land contracting right of management’s concept, the nature, the land contracting right of management circulation’s connotation and the land contracting right of management circulation’s legal characteristic, this chapter of elaboration’s basic theory has built the rationale for the author in the later word stationery body discussion land contracting right of management circulation system. In the second chapter, the author elaborated our country land contracting right of management circulation’s legislative present situation and the practice present situation, this chapter of content’s elaboration has overcome the system and the realistic foundation for the later word. Elaborated in the third chapter of author our country land contracting right of management circulation legal regime’s flaw, and key expressed my own opinion to the legislative insufficiency and the flaw. In the fourth chapter, according to existing legislative insufficiency, the author proposed five consummate legislative suggestion.更多还原
