面向数字图书馆的信息网络传播权优化研究

【摘要】 版权一直都是数字图书馆面临的关键问题之一。《信息网络传播权保护条例》的出台,更是使数字图书馆的发展步履维艰了。面向数字图书馆优化信息网络传播权,是最务实的做法。文章在评述国内外研究现状的基础上,分析了信息网络传播权对数字图书馆发展的影响,同时指出了平衡信息网络传播权的必要性。以介绍国外关于图书馆的信息网络传播权限制与例外规定为基点,通过中外法条的对比分析并结合我国实际情况,从合理使用、法定许可、著作权集体管理等制度的角度优化了信息网络传播权,并考虑到某些特殊类型作品网络传播问题,设计了非物质文化遗产土著文化协议等以完善信息网络传播权制度。鉴于人的自主性和上述优化信息网络传播权方式的“非自我管理性”,文章提倡用创作共用协议的模式优化信息网络传播权,这只是一种理想境界。为了更清晰地展示这几种制度与协议之间的关联,文章最后分析了它们之间的关联关系,给出了一个清晰的定位。更多还原

【Abstract】 Copyright is still among key issues digital library faces. The announcement of Ordinance on the Protection of the Right to Network Dissemination of Information makes the development of digital library face great difficulties all the more. Optimizing the right to network dissemination of information towards digital library is the most pragmatic practice. Based on assessing and commentating domestic and foreign research status, the passage analyzes the impact of right to network dissemination of information on digital library, meanwhile pointing out necessity of balancing right to network dissemination of information. Based on introducing limitation and exception of right to network dissemination of information concerning library, through contrasting copyright laws between China and foreign countries and coupling with our country’s real conditions, we optimize and perfect the right to network dissemination of information from the perspectives of fair use, statutory license, copyright collective management, etc. Considering network dissemination issues of works of certain special types, we design indigene cultural protocol of intangible cultural heritage as to optimize right to network dissemination of information. It is merely a kind of ideal state. To clearly show the relations among these systems and protocols, the passage finally analyzes incidence relation among them and offers a clear orientation.更多还原
