【摘要】 政治权力是国家权力的核心,政治权力运行顺畅是国家政治稳定、经济发展、社会和谐的重要保证,而实现政治权力运行法治化是政治权力运行顺畅的必要途径。政治权力运行法治化是我国实行依法治国,建设社会主义法治国家的题中应有之义。二者之间有着内在的关联性,依法治国作为治国理念和方式,其内在的要求政治权力要依法运行,政治权力的良性运行需要坚持依法治国。以此为逻辑起点,本文以当前我国政治权力运行的现状和存在问题为现实依据,对我国政治权力运行法治化进行可行性分析后就依法治国视野下的我国政治权力运行法治化的实现路径进行探讨。本文一共分为五个部分:第一部分是导论。主要介绍本文选题的原因和意义与研究方法,介绍当前国内外就此问题研究的现状和问题。第二部分是依法治国与政治权力运行。主要论述了依法治国的科学内涵和意义,政治权力的特征和我国政治权力运行机制,依法治国和我国政治权力运行的逻辑关系。第三部分是我国政治权力运行的现状和存在问题。本部分基于现实的角度就我国政治权力运行的现状和存在问题作了阐述。第四部分是我国政治权力运行法治化的可行性分析。主要从理论与实践的层面就我国政治权力运行法治化的可行进行分析。第五部分是我国政治权力运行法治化的建构原则、建构进路和实现路径。本部分是文章的重点部分和难点部分。本部分是在二、三、四部分的基础上,提出实现我国政治权力运行法治化的基本思路,并就我国政治权力运行法治化实现路径做了探索性的研究。更多还原

【Abstract】 Political power is the core of state power. And smooth political power operation is the important guarantee of political stability, economic development and social harmony. So legalization is the necessary approach to smooth political power operation. Legalization of political power operation is an integrant part of running state affairs according to law and building our socialist country under the rule of law. And there exists an internal relevance between both of them. As the philosophy and method of running state affairs, the rule of law requires that all political power should be favorably operated according to law. By logical reasoning, the paper, based on the current situation and the existing problems regarding our political power operation, explores how to realize the legalization of the political power operation from the vision of the rule of law after feasibility analysis.This paper consists of five chapters: The first chapter is an introduction, in which the reasons for selecting this topic and the significance and research methods have been explained. Also the current research situation and existing problems in this field have been pointed out. The second chapter is about the rule of law and political power operation, which discusses the scientific connotation and significance of the rule of law, the features of our political power, the operation mechanism and the logic relationship between the rule of law and our political power operation. The third chapter deals with the current situation of our political power operation and its existing problems. The forth chapter makes a feasibility analysis of legalization of political power operation mainly from theoretical and practical level. The fifth chapter comes up with approaches of legalization of political power operation. It is the key part of the whole paper. Based on discussion and analysis of the previous chapters, the author puts forward the basic principles and requirements of legalization of political power operation and suggests approaches of realization.更多还原
