我国妨害公民个人信息罪立法研究

【摘要】 近年来,妨害公民个人信息的犯罪日益突出,严重影响着公民个人的日常生活以及社会正常秩序。目前,我国对公民个人信息的立法保护仍然不足,因此,笔者建议构建妨害公民个人信息罪类罪体系以更好地保护公民个人信息。针对妨害公民个人信息罪作为类罪在立法上存在的诸多问题,笔者提出了自己的解决措施,即在对修正案(七)新增加的公民个人信息犯罪罪名界定为侵犯公民个人信息罪,在类罪名界定为妨害公民个人信息罪的基础上,笔者具体提出了对侵害公民个人信息罪犯罪构成的完善建议、构建妨害公民个人信息罪类罪体系的具体思路及措施、以及相关程序立法和其它配套立法建议,以期构建一个完善的妨害公民个人信息罪类罪体系,最终以建构一个完整的公民个人信息立法保护体系为落脚点,以期能够提高本罪的司法适用效果。
【Abstract】 In recent years, criminal obstruction of personal information of citizens have become increasingly prominent, seriously affecting the daily lives of individual citizens and the normal order of society. Currently, citizens of our country’s legislation to protect personal information is still insufficient, therefore, I propose the construction prejudice to the crime category crimes of Personal Information System to better protect personal information of citizens. Prejudice to the personal information of citizens for crimes as crimes against humanity in the legislation the existing problems, the author proposes his own solutions, that the amendment (g) additional criminal charges of Personal Information Personal information is defined as violations of civil crimes, in the Class counts of Personal Information is defined as prejudice on the basis of the crime, the author proposes specific information on individual citizens against the crime of the perfect proposal to build the crime categories of Personal Information prejudice the crime system specific ideas and measures and legislation and other related procedures supporting legislative proposals to build a complete obstruction of the crime categories of Personal Information sin system, and ultimately to construct a complete system of legal protection of Personal Information for the end result, with a view to enhance the effect of judicial application of this crime.
