【摘要】 中药是我国的文化瑰宝。早在公元前的约两千年的殷墟甲骨文中就有动植物药的记载。近现代,在前人的基础上,中医药学又迅速发展,开发出了许多有限的现代方剂。国际上,“中草药热”升温,中药农业的发展潜力巨大。据世界卫生组织统计,当前世界60多亿人口中,有40亿人使用了天然药治病,其中大部分是植物药,一个全球化的天然药物市场正在形成。湖北省,素有“中华药库”之称。是我国古代伟大的医学家、药物学家李时珍的故乡。我省更拥有丰富的中药材资源和大量具有地方特色的中药材品种,发展中药产业具有得天独厚的资源优势。一般来说,药品的开发,从选方、试验、试用到投产,要经历长达10年的时间,这其中需要花费大量的人力、物力、财力。中药的开发亦是。中药是人类智力劳动的成功。具有商业价值,因而也是一种知识产权,应当受到法律的保护。在中医药的知识产权角逐日益激烈的今天。我们应该提高这种认识。而且,利用现代知识产权制度对中药的创造性智力成果进行保护是中药行业发展的必然。然而,由于中药本身的特殊性,它的知识产权保护异常困难。而且由于中药与西药的差别,中药在发达国家的不能得到知识产权制度的保护,这样,发到国家的许多公司开始无所顾忌的仿制我国中药,造成我国大量中药的无形资产流失。知识产权的丧失给我国的中药企业带来的巨大的创伤。加强知识产权的保护迫在眉睫。鉴于上述情况,我认为有必要开展湖北省中药知识产权研究。对湖北省的中药知识产权现状进行分析,找出我省在发展中药产业方面具备的知识产权优势和劣势,根据湖北省中药产业知识产权工作中存在的问题,研究如何保护对湖北省中药材进行知识产权创造、管理、运用和保护。为我省发展中医药产业提供理论和实践支持。本文首先通过对中药药材的特殊性进行分析,研究需通过哪些方式来对其进行知识产权保护。其次,在通过多方位的对湖北省中药产业知识产权的发展状况进行研究,找出湖北省中药知识产权发展存在的问题与取得的骄人业绩。最后,针对问题所在,提出湖北省中药知识产权发展的具体对策。构建相对完善的知识产权保护策略。更多还原
