【Abstract】 As environmental pollution is increasing day by day, citizens’ awareness of environmental protection is unprecedented. In practice, it is difficult to clearly distinguish infringement of adjacent environmental pollution and environmental pollution infringement. By analyzing the difference between litigation mode and space, and using the principle of legal economics, combined with the enlightenment of the Hand rule and the Cardo-Hicks Standard, this article made a scientific and effective distinction between the adjacent environmental infringement and the environmental pollution infringement.更多还原
