【摘要】 生态环境损害赔偿诉讼的诉讼标的是广义民事诉讼诉讼标的的一种特别形式。生态环境损害赔偿诉讼的诉讼标的与环境公益诉讼标的具有共通性。生态环境损害赔偿诉讼的诉讼标的是指权利人、赔偿权利人与赔偿义务人之间因环境污染或生态破坏所致环境损害而发生的具有给付内容的争议并要求法院进行审理和作出裁判的对象。以"一体化"、"体系性"民事诉讼标的识别标准来应对生态环境损害赔偿诉讼的相关问题会遭遇解释困境。生态环境损害赔偿诉讼标的应采功能二元化条件下形态相对化分析方法,即在保护生态环境利益功能与保障程序利益功能二元化条件下在诉之变更、合并、重复诉讼、既判力客观范围等方面对重要程序节点进行诉讼标的形态相对化分析。生态环境损害赔偿诉讼与关联诉讼之间的衔接亦可通过诉讼标的理论进行分析。更多还原

【Abstract】 The subject-matter of ecological and environmental damage compensation action is a special form of the object-matter of civil actions in a broad sense,which has commonality with that of environmental public interest litigation. The subject-matter of ecological and environmental damage compensation action refers to the object of the dispute with payment content between the obligee,the obligee for compensation and the obligor for compensation for environmental damage caused by environmental pollution or ecological damage and the court is required to hear and make a judgment. The monistic or systematic paradigm of identification for the subject-matter of ecological and environmental damage compensation action encounters theoretical difficulty of interpretation. Therefore,a method of morphological relativization under the condition of functional dualism should be adopted to identify the object-matter of compensation action for ecological and environmental damage. Accordingly,under the condition of the dual function of protecting ecological and environmental interests and protecting procedural interests,the object-matter of litigation is relativized in terms of alteration or joinder of a claim,ne bis in indem,and objective scope of res Judicata. The connection between ecological and environmental damage actions and related actions can also be analyzed by the theory of subject-matter of action.更多还原
