【摘要】 水污染规制之行政合作是指不同行政主体为了提高效率以合作的方式对水污染进行规制。水污染规制是政府根据一定的规则对水污染的矫治,其实质是行政权力对私主体行为的干预或调控。由于水污染问题涉及多个部门乃至不同地区,单一行政主体在进行水污染规制时往往力不从心,为此需要进行行政合作。行政合作是两个乃至多个行政主体对行政权力的行使,是“公与公”的合作。水污染规制之行政合作既有实践基础,也有理论支撑。水污染规制之行政合作是行政主体的一种“交易”,制度决定了交易成本的大小,决定了行政合作的“绩效”。然而,我国水污染规制之行政合作却存在着大量的制度障碍,包括正式规则、非正式规则以及他们的实施。进行水污染规制之行政合作首先确立流域综合管理的理念,并以此为背景,理顺当前水污染管理体制,选择恰当的合作模式。在合作模式中,较为核心的是流域管理机构的模式。行政协议是水污染规制之行政合作的重要工具,然而,当下行政协议的法治化程度不高,这和行政协议本身不完善有十分密切的关系。完善行政协议至少应当从内容、效力、履行模式、责任机制和争端解决几个方面入手。进行水污染规制之行政合作要依赖制度建设,落实于通过制度实施而形成的具体机制之中。合作规划机制、联合监测机制、联合执法机制、生态补偿机制和信息共享机制是当前亟待建立的几种合作机制,这几种机制实则是制度化或法治化的规制行为合作。更多还原

【Abstract】 Administrative Cooperation in Water Pollution Regulation refers to regulation of water pollution by different administrative bodies in a cooperative manner to improve efficiency .Regulation is a kind of government intervention on private behaviors according to the relevant rules. While Regulation of water pollution is the government’s intervention on water pollution in accordance with certain rules, and its essence is the intervention of administrative power on private behaviors. As the water pollution involves many departments and even different regions, a single administrative body seems too weak in carrying water pollution, and an administrative cooperation is necessary. Administrative cooperation is the exercise of administrative power by two or more administrative bodies; it is a sort of "public to public" cooperation.Administrative cooperation regulation of water pollution has both the practical motivation and the theoretical basis. Administrative cooperation in water pollution regulation is a“deal”in administrative body. The system determines its transactional cost and the "performance" of administrative cooperation regulation. However, within our country there still exist a large number of system barriers in administrative cooperation regulation of water pollution, including the formal and informal rules and their implementation.To select the mode of administrative cooperation regulation in water pollution, the first is to establish the concept of integrated watershed management with which as background to rationalize the current water management system and choose the appropriate co-regulatory mode. In the co-regulatory mode, the mode of watershed management organization is the core.The administrative agreement is an important tool for regulation; however, its legalization is not high, which is closely related to imperfect administrative agreement. A sound administrative agreement should at least be started from its content, effectiveness, performance mode, accountability mechanisms and dispute resolution.Administrative Cooperation Regulation relies on system development and implements in specific mechanism through system. Currently, several urgent cooperation mechanisms established are cooperative planning mechanism , joint monitoring mechanism, joint enforcement mechanism, ecological compensation mechanism and the information-sharing mechanism, which in fact is cooperation of institutionalized and legalized regulation.更多还原
