【摘要】 刑名是一个法学基本概念,亦即刑罚的名称。迄今为止中国古代刑名的研究仍局限在法学领域,研究者多为法学界学者,他们在研究中大多将古代刑罚看作古代刑法史的基本组成部分,重点对某个刑罚的有无进行说明,而缺少详尽的考证,致使古代刑名的研究仍然处于比较薄弱的阶段。本论文尝试以新的视角为切入点,将古代刑名看作古汉语词汇系统的一部分,采用语言文化相结合的方法对中国古代刑名进行研究。具体方法为,在充分利用现有法律材料的基础上渗入语言分析因素,诠考每个刑名的命名、演进、特征、相关词语、文化背景等方面内容。既有对刑名的解释说明,也有对一些疑点难点的考证。这些研究可使刑名研究在概念上更趋准确严密,在内容上更加丰富翔实,因而对法学领域具有一定的参考作用。另外,由于刑名研究的不足,使得部分字典辞书中的有关刑名词条的注解也存在一些不准确、错误、漏释等问题。本文对此进行了分析并提出了自己的意见,希望对辞书的进一步完善有所帮助。本文的绪论介绍了古代刑名的研究现状;正文研究了65个刑名,这些刑名根据性质特征分为五类,即生命刑、身体刑、自由刑、财产刑和耻辱刑;最后是附录,有专题研究,刑罚存现表和插图。更多还原

【Abstract】 The names of punishments belong to the law categories. Up to now, the studies on the names of punishments which existed in ancient China are still confined to the field of law. Most of the scholars take the punishments as a basic part of the history of the criminal law. Their studies mainly focus on the existence of the punishments and neglect the textual research about the details. As a result, the studies on the names of punishments are still weak relatively. From a new point of view, this paper regards the names of punishments as a part of ancient Chinese vocabulary, carries out the principle of integrating linguistics and the culture of law. With a method of adding linguistic elements to the law materials, this paper tries to give every punishment its nomenclature, developing, characteristics, related terms, culture background, etc. This paper has not only the annotation but also textual researches on the puzzle problems about the punishments. It could make the studies on the old punishment more detailed and accurate. and It would be a good reference to the field of law. In addition, there are certain defects such as inaccuracy, mistakes, and errors of omission in some dictionaries. This paper has given some analysis and suggestions for the revising of the dictionaries.The preface of the paper is an introduction to the present research situation; The main body of the paper has studied 65 names of Chinese ancient punishments which are divided into 5 categories according to their properties, namely, death punishments, corporal punishments, imprisonments, property punishments, and humiliating punishments.
