我国道路交通事故社会救助基金法律问题研究

【摘要】 交通事故社会救助基金是政府主导的行政性社会公益救助,是向交通事故受害者提供救助的应急机制。我国现行的交通事故社会救助基金相关立法较为简单,同国外的先进立法相比,现行的《道路交通事故社会救助基金管理试行办法》等法律的一些内容,未能体现该基金的社会救助的性质,且不当排除了部份应予救助的交通事故受害者,在基金的资金筹集,基金救助对象、救助范围、管理体制上存在诸多瑕疵。本文主张,道路交通事故社会救助基金的设置要从实际救助的要求出发,从而科学地制定相应的管理制度和办法。文章分为三个部分:第一部分,道路交通事故社会救助基金的基本理论。研究交强险的法律特点,通过将交强险与该基金进行相应的比较,得出基金的基本法律特征,为下面对我国交通事故社会救助基金的立法现状进行评价提供理论依据。第二部分,我国交通事故社会救助基金立法评述。以第一部分得出的该基金的基本法律特征为依据,阐述当前我国道路交通事故社会救助基金的立法现状,并着重对当前的立法内容,尤其是刚刚颁布的《交通事故社会救助基金管理试行办法》的不足之处进行探讨。第三部分,完善我国交通事故社会救助基金的立法思考。通过简单介绍德国、南非、澳大利亚新威尔士三地有关该基金较为先进的立法经验,并结合我国的实际国情,对完善该基金制度建设进行相应的立法思考和建议。更多还原

【Abstract】 Accident Fund is a government-led social assistance administration of public welfare assistance, is providing relief to victims of traffic accidents emergency response mechanism. China’s existing social assistance fund accident related legislation relatively simple, compared with foreign advanced legislation, the existing "social assistance fund for road traffic management on a trial basis," and so some elements of the law, failed to reflect the nature of social assistance funds and do not be relief when the excluded part of the traffic accident victims, to raise funds in the fund, the fund relief object, the scope of relief, the management system, there are many flaws. This paper argues that, road traffic accidents from the social assistance fund set up practical aid requirements, and to scientifically formulate corresponding management systems and methods.Article is divided into three parts:The first part, road traffic accidents the basic theory of social assistance funds. Pay compulsory insurance laws of the characteristics, by Traffic Insurance and the Fund accordingly, and obtains the basic legal characteristics of the Fund for the following traffic accidents on China’s social assistance funds to evaluate the status of the legislation provide a theoretical basis.The second part, my comments accident social relief fund legislation. Drawn to the first part of the basic legal characteristics of the Fund based on road traffic accidents in China described the current legislative status of social assistance funds, and focus on the current legislation, in particular, has just promulgated the "traffic management pilot scheme of social assistance funds "The weaknesses of the study.The third part, Improvement of Traffic Legislation of Social Assistance Fund.
