高速公路广告控制区规制研究

【摘要】 高速公路广告控制区的建立,涉及专业的法律及技术等因素,对高速公路广告控制区内的广告牌进行规制,有利于对高速公路两边的广告进行有效的管理,能够创造良好的行车环境。高速公路广告作为高速公路的衍生产品,具有直观性强、视觉冲击力大的优点,为广告业提供了新的平台。高速公路广告发展迅速,几乎涵盖了“制造、房地产、医疗、教育、能源”等产业。高速公路广告也存在许多问题。本研究的目的是:将高速公路广告控制区作为经济法调整对象,对现实中高速广告的无规则泛滥,严重干扰司机的注意力,给路产带来隐患等现象开展法律分析。本文的研究方法:主要运用《经济法》的理论,同时也涉及《法学基础理论》、《民商法》、《中华人民共和国行政许可法》、《中华人民共国公路法》、《中华人民共和国广告法》、《中华人民共和国公路管理条例》、《关于加强高速公路服务设施建设管理工作的指导意见》、《收费公路权益转让办法》等法律法规。本文突破传统的纯文科研究方法,采用文科、工科结合的思维,将法律与科学试验相结合,对高速公路广告控制区进行分析论证。例如本文参考了技术标准参数选择的模拟试验(涉及力学破坏性试验、汽车司机眼动频数与路产安全等关系试验),以我国高速公路广告为研究对象,提出政府管理高速公路广告的范围。本文继承了贺宏斌教授的观点,主张在高速公路两侧一定范围内,建立高速公路广告控制区,施行高速公路广告特许经营,从而使高速公路广告得到有效管理,最大限度地为高速公路发展和交通出行服务。本论文研究结果为:作者在导师贺宏斌教授带领下与其他同学共同合作,形成了集法律与交通工程参数于一体的《高速公路广告设置管理与技术规定》法律建议稿(见附录),为高速公路广告设置管理立法提供建议方案。为进一步规范高速公路广告的管理,实现高速路政执法的人性化与互动性,作者与信息学院同学合作,研发了“高速公路广告控制区相关路政信息即时反馈系统与网站”,该网站是一个集路政信息、路权信息,投诉与反馈信息,以及相关法规信息于一体的系统。实现路政信息投诉方式的多元化。本论文结论为:从技术行政与技术创新的视角,以经济法理论为基础,提倡在我国推行高速公路广告控制区管理,认为高速公路广告控制区应由经济法来调整,提出解决高速公路广告设置的技术参数极限标准的科学建议。在2009年6月专家论证会上,该技术标准已经得到陕西省交通厅、陕西省交通建设集团、陕西省高速集团及长安大学等领导专家的认可。
