【摘要】 目前我国正处于电子电器产品大量更新换代及大批量生产阶段,电子电器废物不仅种类繁多,而且成分复杂,含有多种有毒、有害物质,已经成为固体废物中最大的重金属污染源,如果以传统的“资源-产品-废物”的发展模式,则发展速度越快,付出的环境代价越大。同时,欧盟颁布了有关法令,对废旧电子产品的再生产、再利用率做出了规定,并规定回收再利用的费用由生产者负责,这将影响我国电子电器产品的出口,削弱我国企业的国际竞争力。为此,应该积极应付,尽快制定有关法律文件,在循环经济立法的大背景下,推进电子电器产品资源环境再利用体系的建立。这是一项复杂的系统工程,它涉及政府、生产商、进口商、消费者等各方的责任和利益,建立一个由各方分工协作、责任分摊的管理体制和运行机制至关重要。要在企业中实行“生产者延伸责任制”,进行产品回收管理,使产品的整个经济链得以闭合,这是将环境外部性内部化的重要制度。同时,还要建立电子电器产品和废物的规划制度、强制回收制度、电子废物回收拆解资质制度等各种基本制度,构成电子电器废物管理的制度体系。立法是解决电子垃圾污染的最重要的一个环节,没有法规就没有有效的监管,立法能够对生产者责任延伸和消费者社会责任起到引导作用,从而有利于问题的解决。本文通过分析现有立法的缺陷,结合国内某些企业和行业的实践,以及发达国家电子电器废弃物管理的经验,立足于我国的实际情况,对我国的电子电器废物管理的法律制度建设提出建议,并提出进行电子电器废弃物管理专门立法的法律构想。更多还原
