【摘要】 在新军事变革和高技术局部战争背景下,各国军事和经济竞争的实质是技术创新能力的竞争。军事科学研究在其中发挥着至关重要的作用。军事科研成果的创造、运用、保护和管理有赖于知识产权法律制度的保障。《国家知识产权战略纲要》明确将国防知识产权纳入了国家知识产权战略的专项任务,成为完善军事科研成果知识产权保护和管理制度的重要政策依据。军事科研成果知识产权归属、利用和共享的制度设计,应当充分发挥产权的激励功能,充分考虑国家、研究者和社会之间的利益平衡。我国军事科研成果知识产权长期存在权属不清晰、利用不规范、共享不到位等问题,严重挫伤了军事科研单位和个人进行技术创新的积极性。完善军事科研成果知识产权归属、利用与共享的新制度,是实施国家知识产权战略,增加我国国防知识产权总量,增强我国国防实力,提高我国国防科技工业国际竞争力的迫切需要和关键环节。域外国防知识产权归属和利用的实践,可以为我国的制度建设提供参考。美国、日本、德国、俄罗斯等国政府采取有条件放权,制定了比较灵活的国防知识产权归属和利益分配的政策,“放权让利”已成为各国解决政府资助形成的发明成果知识产权归属问题的基本原则。完善我国军事科研成果知识产权归属、利用和共享制度,一是要加快军事科研院所改制步伐以理顺产权关系,二是建立军事科研信息系统以实现军内信息资源共建共享,三是促进军民结合科研成果的创造和产业化应用,四是完善军事科研成果知识产权归属、利用和共享的法律和政策。更多还原

【Abstract】 In the background of new military change and high-tech partial war, the substance of military and economic competition is ability of technology innovation. Military science research plays an important part in it. The creation, utilization, protection and management rely on the protection of Intellectual property system. The compendium of national intellectual property strategy brings the national defense intellectual property into the special mission of national Intellectual property strategy, and it becomes the important policy bases of the perfecting of the protection and management system of military research fruit.The design of the system of attribution, utilization and of military research fruit should fully exert the prompting function of property right, fully considerate the balancing of interest between the country, researcher and society. There are many problems such as dimness of property, non-normative utilization in our country’s intellectual property of military research fruit, and these problems strike the military research institution and researcher’s enthusiasm of technology innovation. Perfecting the new system of attribution, utilization and of military research fruit is the impending need and key point of implement of national intellectual property strategy, increasing the quantity of our country’s intellectual property, improving the strength of national defense and advancing the international competitive force of our national defense industry.The practice of attribution and utilization of national intellectual property overseas can provide reference to the construction of our system. The government of USA, Japan, German, Russia and so on take the action of releasing right conditionally, and enacting the flexible policy on the attribution and utilization of national intellectual property. Releasing right and relinquishing interest become the basic principle in solving the problem in attributing the intellectual property of invention which was subscribed by the government.In order to perfect the system of attribution, utilization and of military research fruit, the first thing we have to do is mending the pace of reforming system of the military scientific research institution to coordinate relation of the property right. The second thing is establishing the information system of military scientific research to realize the co-instruction and sharing in the army. The third thing is prompting the creation and industrialization appliance. The forth thing is perfecting the law and policy of attribution, utilization and of military research fruit.更多还原
