论信用卡消费者权益的保护

【摘要】 近年来,我国的信用卡产业呈现逐步发展的良好态势,并已经成为全球发展潜力最大的国家。但是,由于信用卡的虚拟性和电子性,与传统的信用凭证和支付工具相比,信用卡的消费者更容易受到侵害。本文从信用卡的发展现状出发,剖析信用卡当事人的法律关系,揭示信用卡业务中侵犯消费者权益的问题,并结合国际上关于信用卡消费者权益保护的相关规定,对我国信用卡交易法律制度的完善提出建设性的意见,以期构建一个完整的权利保护体系,使交易风险得到有效的控制。本文由引言、正文和结语三部分组成。正文分为五章:第一章为信用卡概述以及各当事人之间的法律关系。介绍了信用卡的发展历程,从法律的角度出发,对信用卡当事人予以定位,探讨了各方法律关系,明确持卡人作为消费者应予以特别保护。第二章为信用卡业务中侵犯消费者权益的问题。针对目前我国信用卡消费者权利保护的现状,分别对信用卡持卡人知情权的侵害、信用卡持卡人隐私权的侵害、信用卡丢失后的风险责任承担以及信用卡持卡人的抗辩权等问题进行了探讨,指出权利保护体系中的诸多重要权利未得到有效保障。第三章为国内外信用卡消费者权益保护立法的评析。国际上许多国家,特别是信用消费比较发达的国家,十分重视信用消费立法工作,很多国家制定了专门的单行法,并非常重视对消费者权益的保护。文章通过将我国法律规范对消费者权益的保护与美国、英国、我国台湾地区的信用卡消费者权益保护机制进行比较,总结信用卡业务发达的国家和地区的成功经验,以期对我国信用卡消费者权益保护的立法加以借鉴。第四章为我国信用卡消费者权益保护立法的发展思路。通过前文提出的我国信用卡业务中存在的侵害消费者权益的种种问题,挖掘我国信用卡立法的种种缺陷后,借鉴发达国家和地区的成功经验,提出制定保护消费者权益得专门立法、提高立法层次、确立保护消费者权益的立法理念、制定全国统一的信用卡业务合同范本、完善个人信用法律制度等立法的发展思路。希望以次使信用卡消费者真正享有合法权益,并在权利受到侵害时得到充分、有效的救济。第五章为我国信用卡消费者权益保护体系的建立。为了保障消费者权益得到真正的保护,应该在立法中对侵害消费者权益的情形加以明确规制,建议完善的消费者权益保护体系,以保障消费者的知情权、隐私权、抗辩权的行使,在发生冒用风险是合理的分配发卡银行与持卡人之间的风险责任。

【Abstract】 In recent years, our country’s credit card industry presented the good situation which developed gradually, and already became the most development potential country of the whole world. But, as a result of credit cards hypothesized and the electron, compares with the traditional credit certificate and the means of payment, credit card’s consumer is easier to receive the violation. This article embarks from credit card’s development present situation, analysis credit card litigant’s legal relationship ,revelate the questions of encroaches upon the consumer rights and interests in credit card service., and unifies the related stipulation about the credit card consumer rights and interests internationally, gives the constructive comment to our country credit card transaction legal regime’s consummation, hope to construct a complete right protection system, enables the transaction risk to be under the effective control.This article is composed by the introduction, the main text and the conclusion. The main text divides into five chapters:The first chapter is the credit card outline and litigants’ legal relationship. Introduced credit card’s development process, from legal angle embarking, located to the credit card litigant, discussed all quarters legal relationship, clear about the cardholder to give the special protection as the consumer.The second chapter is the question in the credit card service encroaches upon the consumer rights and interests. In view of present situation of our country credit card consumer rights protection, separately discuss about the violation to credit card cardholder’s right to know, the violation to credit card cardholder’s right of privacy, the risk responsibility undertakes after the credit card loses and the credit card cardholder’s right of contradict, point out that there are many important rights have not obtained the effective safeguards in right protection system’s.The third chapter is the evaluation of the domestic and foreign credit card consumer rights and interests protection legislation. Many countries, specially the credit expends quite developed country, value the work of expense legislation, many countries have formulated the special specific law, and take seriously on the consumer rights and interests protection. In this article, through the comparison between our country’s legal norm to the consumer rights’ and interests’ protection with American, British, our country Taiwan area’s credit card consumer rights and interests protection mechanism, summary the successful experience from credit card service developed country and local, using for reference to our country credit card consumer rights and interests protection’s legislation.The fourth chapter is the development mentality of credit card consumer rights and interests protection legislation in our country. From the questions of violates the consumer rights and interests in our country’s credit card service mentioned in the preamble, after unearthing all sorts of flaws in our country credit card legislation, profit successful experience from the developed country and the local, propose that the formulation consumer protection rights and interests legislate specially, enhances the legislative level, establishment legislative idea of consumer protection rights and interests, formulates the national unified credit card service model contract, consummates individual credit legal regime. Hoping to enable the credit card consumer enjoys the legitimate rights and interests truly by this, and having effective relief when the right receives the violation obtains.The fifth chapter is the establishment of credit card consumer rights and interests protection system’s in our country. In order to safeguard the consumer rights and interests, we should clear about the rules and regulations on the situation violate the consumer rights and interests in the legislation, establishment perfect consumer rights and interests protection system, to safeguard the consumer’s right to know, the right of privacy, the right of contradict, reasonable divides with the risk allocates between the card bank and cardholder’s risk responsibility when braves with the risk occurs.
