黄浦江上游水源地生态补偿制度研究

【摘要】 黄浦江上游水源地是上海市当前最为重要的水源之一,也是中国最大的城市饮用水源之一,其水质的好坏关系着整个上海市的可持续发展。黄浦江上游水源地通过限制产业、生态建设和环境治理等方式,逐步控制住本地大多数污染源,但水源地的发展和水源地居民的收入要远落后于同区域的其他地区。同时,黄浦江是太湖流域的下游水系,大部分水量来源于上游,但上游来水的水质逐年下降,给水源地造成了沉重压力。本文结合国内外已有的生态补偿理论,对生态补偿的概念和原理进行归纳总结。对黄浦江上游水源地、上游来水以及上海市饮用水水源发展进行研究,分析其水环境现状和污染源问题,对在黄浦江上游水源地建立生态补偿制度的必要性进行论证。再根据黄浦江上游水源地实际情况,设计一套合理的生态补偿制度,特别是跨界生态补偿问题。最后,在对现有生态补偿法律规范分析的基础之上,构建流域生态补偿的上位法规范体系。

【Abstract】 The water source of the upper Huangpu River is one of the most important water sources in Shanghai City and one of the largest water sources in China, and the water quality of the water source bears on the sustainable development of Shanghai City. The water source controlled the most local polluters through limits on industries, ecological restoration and environmental management, but the development of the water source and the income of the residents is far behind other places in the same region. In addition, Huangpu River is the downriver of Taihu Lake Basin and most water of the river comes from head water area, but the declining water quality from the upper reaches gives a heavy pressure to the water source.In this paper, the concepts and principles of eco-compensation were summarized after studying on the domestic and international theory. The status quo of water environment and the problems of pollutant sources were analyzed after studying on the water source of upper Huangpu River, upland water and the development of the drinking water sources of Shanghai City. According to the fact, expound and prove the necessity of establishing the eco-compensation mechanism in the water source and design the mechanism, especially the inter-regional eco-compensation mechanism. At last, the law system of valley eco-compensation is constructed after analysing the existing regulations.
