物业管理纠纷的解决机制研究

【摘要】 随着我国住房制度的改革,住房私有化幅度加大,个人逐步从单位体制中解放出来向“社区人”转变,社区建设和房屋也成为公民关注的焦点,公众对房屋质量和综合服务的要求也越来越高,这样物业管理作为一个新兴行业出现,并开始与我们的生活越来越紧密地联系起来。但是从目前的社会发展来看,我国城市社区的物业管理活动存在不少问题,物业管理依然是一个新兴的、有待逐步完善的行业,这不仅表现在人们对物业管理模式、物业管理定位的观念存在偏差,也表现于物业公司运作不规范,工作人员专业素质不高,以及物业管理法律法规不健全等等,多重因素的作用与影响导致物业管理纠纷愈演愈烈。同时,物业纠纷领域中纠纷解决机制严重落后于社会需要的现实,使层出不穷的物业纠纷得不到及时有效的处理与化解,严重影响了我国和谐社会的构建。本文首先对物业管理纠纷的相关概念进行了界定;然后对社区物业纠纷的现状、纠纷不断加剧的原因以及所造成的不利影响进行了系统的分析;紧接着总结了国外在物业管理方面的先进经验和我国现行纠纷解决方式的不足之处;最后,结合我国的实际情况,以“以人为本”和“合作共赢”为原则,从“骨架”和“筋脉”两个方面进行物业纠纷解决机制的构建,最终在多方博弈的竞争中实现社区利益均衡与社会和谐。

【Abstract】 Accompany with the housing reforming and privatization increasing,Individuals in china have been gradually liberated from“unit system’’to the‘‘community’’.Citizens gradually put their focuses on community development and housing problems and up—level their requirements on housing quality and comprehensive services.Under the above background,Property Management appeared to be a new business and more and more closely linked with our day-lives.However, taking the current social development into consideration,the property management activities of Chinese urban community now have many problems.Property management is still an emerging and improve—requesting industry.The public have not only misunderstand on property management pattern and property management location,but also many other problems,such as the property’s non-standard operation mode,the low—quality of professional staff, property management laws and regulations,property management non-standard behavior, and SO on. Multiple factors lead to the property management disputes which become more and more complex At the same time.the fact that disputes settlement mechanism in the area of property management falling behind the real-needs which lead to the disputes not resolved timely and effectively, seriously affected harmonious society construction.In this paper, the author first stated the notion of the property management,and then made a systematic analysis on the status of community property disputes,the reasons as well as the negative impacts;concluding the advanced experiences of property management in foreign countries and the shortages of Chinese property management disputes resolving ways ; at last , under the principle of“people oriented”and“cooperation for mutual-beneficial’’and the enviroment Of China’s actual conditions,the author constructed the property disputes resolving system from two levels:“skeleton”and“veins”,achieving an interests balance of the community and social harmony by the multi-game competition finally。
