纪检监察“派驻统管”体制初探

【摘要】 实行纪检监察派驻机构统一管理体制,是党的十六大后党中央为改革和完善纪检监察工作体制、加强党内监督作出的一项重大决策部署。提出这一体制改革措施,目的是通过上级纪检监察机关对纪检监察机构的统一管理,增强纪检监察派驻机构行使监督权的独立性和权威性,变“同体监督”为“异体监督”,摆脱原先上级纪检监察机关和驻在部门党政领导班子“双重领导”体制造成的种种困境。然而,由于制度设计的不尽完善和实践推行过程中的种种主客观条件限制,纪检监察派驻机构统一管理体制虽然显现出一定的成效,但总体上效果并不十分理想,在实践中表现出不少不尽人意的地方,与体制改革设计时的初衷还存在不小的距离。本文在对纪检监察派驻机构统一管理体制的提出、制度设计构想、当前的实践、取得的成效和遇到的困难进行系统全面分析的基础上,通过与古今中外相关监督机构设置和管理体制的对比,寻找问题存在的“根源”,发现规律性,从而提出重构纪检监察派驻机构统一管理体制理论模型框架的初步设想,并就当前完善纪检监察派驻机构统一管理体制应当突出的几个着力点提出对策建议。更多还原

【Abstract】 Implements the disciplinary inspection to supervise accredits the organization global administration system, after is party’s 16 big, Central Party Committee to reform and consummate the disciplinary inspection compliance function system, to strengthen a major decision deployment which the inner-party inspector general makes. Proposed that this organizational reform measure, the goal is through the higher authority disciplinary inspection Supervision department to the disciplinary inspection watch-dog agency global administration, the enhancement disciplinary inspection supervises accredits the organization to exercise the supervisory authority independence and the authority, changes "the consubstantiality surveillance" is "the foreign body surveillance", gets rid of the original higher authority disciplinary inspection Supervision department and is stationed at all sorts of difficult positions which the department party politics management "the dual leadership" the system creates.However, because the system design’s endless consummation and in the practice carrying out process’s all sorts of subjective and objective condition limit, the disciplinary inspection supervises accredits the organization global administration system, although appears certain result, but as a whole effect not very ideal, in reality displays the place which many are unsatisfactory, with organizational reform design time original intention also existence not small distance. This article in supervises to the disciplinary inspection accredits the organization global administration system to propose, the system design conception, the current practice, obtain the result and meets the difficulty carries on the system overall analysis in the foundation, through is related the cognizant agency establishment with the ancient and moderns in China and abroad and management system’s contrast, seeks for the question to have "the root", discovers the regularity, thus proposed that the restructuring disciplinary inspection supervises accredits the organization global administration system theoretical model frame the preliminary idea, and on current consummates the disciplinary inspection to supervise accredits several points of application which the organization global administration system must highlight to put forward the countermeasure proposal.Full text altogether 33,000 characters.更多还原
