【摘要】 传统的农村保障,实质是以土地为核心的保障。土地的保障功能在缓解工业化进程中的社会阵痛方面发挥了重要作用,但随着土地福利化倾向的增强和农村经济社会的发展,现阶段中国土地的保障功能越来越被削弱。然而,在目前找不到任何能够取代土地来为农民提供基本保障的物质条件的情况下,只能以土地承包权为核心建立农村社会保障制度。土地制度与我国农民的社会保障有着密不可分的联系,土地制度的变革影响着土地保障功能的发挥。当前我国的农村家庭保障功能已逐渐削弱,无法抵御日益增加的种种社会风险;城乡二元对立的经济与社会结构使农村的社会保障困难重重;农村土地保障本身由于存在很大的缺陷,进一步导致了农村社会保障体系建设滞后、土地均分制下的低效率以及农村城镇化进程缓慢。因此,我们应当通过强调农村土地生产资料的经济功能进而提高其社会保障效用,同时,应根据农村实际,多渠道筹措资金,建立健全农村基本社会保障制度,优先落实失地农民的社会保障,尽快实现科学完善的农村社会保障制度。本文从产权理论和社会保障实务的角度出发,立足于农地产权制度,在借鉴了国内外研究动态的基础上分析了我国农地产权制度的保障性功能,提出了我国农地产权制度的构建应该实现经济效率基础上的社会保障功能。这是社会转型的要求,是我国实现现代化和城市化的前提。文章共分五部分,第一章为理论基础,分别介绍了研究背景和意义、研究动态以及研究思路与方法;第二章介绍了我国当前农地产权制度的设计,包括我国当前农地产权制度设计的主要目标、我国当前农地产权制度改革的必然性、我国当前农地产权制度的基本内容、制度设计的功能及制度设计的缺陷;第三章分析了基于当前农地产权制度下的我国农村社会保障问题,主要论述了农地产权制度下的我国农村社会保障问题的演变及对问题的分析;第四章分析了农地产权制度与社会保障的相互关系、建立和完善农村社会保障制度的总体原则;第五章提出构建符合国情的农村社会保障制度的对策,并把这一问题放在社会变革的大背景下进行宏观思考。更多还原

【Abstract】 In the traditional rural social security, land is the core essence of the protection of the function and it played an important role in the process of easing the social pains of industrialization. But with the tendency of land being enhanced and rural economic and social development, China’s land protection function is increasingly being undermined.However, with nothing to replace the current land to provide basic protection for farmers material conditions, can we only focus on the land contract to establish rural social security system.Land system and social security of farmers in China are inextricably linked, the changes affects the land system’s protection into full play.Currently, security features of rural families have been gradually weakened that farmers can not be able to resist the increasing variety of social risk; urban-rural dualistic structure of the economic makes various difficulties of social security in rural areas;And a lot of deficiencies of rural land’s protection lead to the lagged rural social security system , the low efficiency under the land equalization system and the slow process of rural urbanization. Therefore, we should be concentrate on the means of production by emphasizing the economic function of rural land and thus improve the effectiveness of their social security.At the same time, in rural areas we should be based on actual, multi-channel financing to establish a rural basic social security system to give priority to the implementation of social security of landless peasants, so as to realize the scientific and perfect rural social security system as soon as possible.From the property rights theory and practice of social security point of view, based on the agricultural land property rights system, drawing on its research after the analysis of dynamic agricultural land in China’s protection of property rights system functions, the article makes its point that the construction of agricultural land property system should be emphasized the social security function on the basis of the economic efficiency. This is a requirement of social transformation and the premise of China’s modernization and urbanization.There are five parts to this report: the first chapter is the theoretical basis, introduced the research background and significance of the dynamic and research ideas and methodologies; the second chapter describes China’s current agricultural land property rights system design, including the main objectives of the design ,the necessity of reform, the elements of the plan and the system design’s features and flaws;the third chapter analyzes the property rights system based on the current agricultural land under the Rural Social Security, which mainly discusses the property rights of land under the Rural Social Security Evolution and analysis of the problem; the fourth chapter indicates the relationship between the agricultural land property rights system and social security system and the general principles of establishment and improvement of rural social security system; the fifth chapter proposes the countermeasures of constrcting rural social security system meeting national conditions and put the issue of social change into the macro context of thinking.更多还原
