【摘要】 言论自由是公民的一项重要的宪法权利,宪法权利只有在实践中具有实效方能发挥作用。我国在立宪时已认识到言论自由和媒体舆论监督的重要性,并于《宪法》中规定了言论自由的保护条款及保障措施。但随着近年来媒体事业的迅速发展,其社会影响力与日俱增,媒体监督功能日显突出,作为言论自由的一项扩充表现,新闻自由是媒体舆论监督得以实现的重要前提和保障。因此,正确发挥新闻媒体舆论监督作用是加快政治民主化进程的客观要求,也是建设社会主义和谐社会的重要保障。文章肯定了媒体监督实际上是宪法言论自由和批评建议权利的延伸,言论自由的保护既要在立法中得以体现,又应在司法实践中避免一些适用上的偏差。目前我国媒体的舆论监督功能发挥有限,面临多种阻力和干扰,如何保障新闻自由,保障新闻媒体的舆论监督权利和职能,防止新闻舆论监督权在实施过程中出现不应有的失位、错位和越位,保障公民的知情权、记者的采访权,规范新闻行业及新闻从业人员,都需要构建完善、可行的新闻立法体系,并重塑媒体监督与司法实践的协调机制,从而使目前的新闻媒体从意识形态管理向法治管理转变,在法律框架内充分发挥媒体监督的自由权,保证媒体的新闻自由权,更好地发挥媒体的监督作用。因此,媒体运行与法治进程的并行发展,既是法学研究领域的重要课题,同时也是新文学界迫切寻找的法理依据。文章将言论自由这项公民的重要宪法权利生活化、精细化,从媒体监督的视角,将权利由“条文”转化为“实际”,试图解决媒体发展过程中面临的法治缺失的尴尬,并将宪法保护的言论自由朔定为双轨制保护,即立法构筑与司法实践两个层面,在探究媒体监督的法治路径的过程中,逐步确立媒体与法治的协调机制,为进一步完善我国新闻立法提出建议。更多还原

【Abstract】 Freedom of speech is that civil important one constitution right, constitution right are able to produce a marked effect only when having actual effect in practice.
