【摘要】 随着2007年《物权法》的出台和全国人大常委会对《城市房地产管理法》的修改,《拆迁条例》在法律条文的规定上都已经显得与这些上位法格格不入,导致各地拆迁矛盾更加激化。因此,制定通过新的《拆迁条例》已迫在眉睫。2010年1月29日,《国有土地上房屋征收与补偿条例(征求意见稿)》正式面向社会各界公开征求意见,成为拟制中的《征收与补偿条例》出台的前奏,有望在法律制度层面上对拆迁法律关系进行彻底调整。通过对法律条文的对比和分析,研究《征收与补偿条例》的价值追求及在这些价值指导下设置的应有程序,有利于进一步理清拆迁法律关系,认识拆迁法律关系内容。拟制中的《征收与补偿条例》将彻底改变《拆迁条例》的法律性质,重新定位拆迁法律关系,在内容上更加丰富,在价值的追求上更趋合理,将建立全新的征收程序、补偿程序和争议处理程序,将更加关注和平衡各方利益。对拟制中的《征收与补偿条例》若干问题特别是程序方面的探讨,有利于我们分析我国现行拆迁法律制度应该如何进一步完善和改进,以使其能够适应社会经济的发展要求,加快城市化的发展。更多还原

【Abstract】 With the’Property Law’promulgated in 2007 and the National People’s Congress changed’The Urban Real Estate Management Law’, the provisions and the guiding spirit of the’Demolition Ordinance’,were both out of tune with these higher-level laws, resulting in more intensified conflicts around the demolition and removal issues continue to be staged. So, to amend the development through the new Demolition Regulations is imminent. January 29,2010,’State-Owned Land on The Housing Levy and Compensation Ordinance (draft)’was official published to comment for the community and will promulgated the new’Housing Levy and Compensation Ordinance’a prelude, to expect a thorough adjustment in the legal system of legal relations on the demolition,through comparative analysis of the law, we study the ordinance value and the pursuit of the guidance provided in the value of’Housing Levy and Compensation Ordinance’further clarify the removal of legal relations, understand the content of legal relations demolition.Fiction of the’Housing Levy and Compensation Ordinance’will completely change the legal nature of the Demolition Ordinance, repose demolition legal relationship, rich in content, in pursuit of the more reasonable value. It will establish a new collectting procedures, compensation procedures and handling procedures in disputing, it will pay more attention on balance of interests. This article is intended to study a number of issues through the comparing of the new system for the demolition ordinance, through the discussions of special procedures, to discuss how the demolition of the existing legal system in China further refine and improve, to enable them to adapt to social and economic development requirements, to accelerate the development of urbanization.更多还原
