我国政府绿色采购制度研究

【摘要】 政府绿色采购是指特定机构在政府采购的过程中要强制或优先采购符合国家绿色认证标准的货物、工程和服务。在当代,政府绿色采购制度已经成为世界各国实施可持续发展战略的重要措施和有效手段。从世界各国实施政府绿色采购制度的实践来看,政府采购中的“绿色因素”对于刺激绿色产业的形成、提高社会公众的环保消费理念、推动环境友好型、资源节约型社会的建立、树立良好的政府形象都发挥着非常重要的作用。但是我国的政府绿色采购制度起步较晚,缺乏相关理论支撑,各项制度都还处于探索阶段,使得我国在发挥政府采购的绿色功能效用上明显滞后。因此,完善我国的政府绿色采购制度非常重要。论文在分析我国政府绿色采购制度中存在的各种问题的基础上,建议完善我国相关法律法规,在《政府采购法》中设专章对政府绿色采购的当事人、供应商资格、绿色采购清单以及鼓励措施等进行规定,同时要制定相应的政府绿色采购实施条例,具体规定绿色采购清单的制定程序、环保产品认证标准等事项,健全政府绿色采购的管理机构并明确各部门的管理责任、建立有效地信息交流渠道,还需要完善政府绿色采购的配套措施等进一步完善我国的政府绿色采购制度,实现环境保护的目标。论文共分为四章：第一章是引言,主要论述政府绿色采购制度的选题背景和现实意义,强调了政府绿色采购制度在当今国际社会中的促进环境保护、推进绿色消费的强大功能,结合国内外政府绿色采购的研究状况,指出完善我国政府绿色采购制度的重大意义。第二章讨论政府绿色采购制度的基本问题。首先界定了政府绿色采购的概念,分析其特征,并对政府绿色采购的功能进行论述；其次以美国、同本等国为例介绍政府绿色采购的演进,分析各国政府绿色采购的发展经验；最后对政府绿色采购的基本架构进行论述,包括原则、适用范围以及政府绿色采购的认证标准等。第三章从我国政府绿色采购制度的立法现状以及实施状况入手,着重分析目前存在的相关法律法规可操作性不强、认证标准不统一、采购范围有限、管理体制不健全、交流渠道不畅通等问题。第四章结合我国实际,在借鉴发达国家实践经验的基础上,集中讨论完善我国政府绿色采购制度的若干建议,力求使我国的政府绿色采购制度得到有效实行并达到更好的效果。更多还原

【Abstract】 The Government Green Procurement refers to the specific institutions in the government procurement process should be mandatory or priority to the purchase in line with national green certification standards for goods, works and services. In modern times, the Government Green Procurement legal system has become the world’s nations to implement sustainable development strategies, important measures and effective means. From the practice of Government Green Procurement around the world, the "green factor" for the formation of stimulating green industry to raise the public’s concept of green consumption and promote the establishment of environment-friendly and resource-saving society, has played a very important role. However, the Government Green Procurement legal system in China got a late start, lack of relevant theoretical support, the rules are still in the exploratory stage, allowing our country to play the Green function of the effectiveness of Government Green Procurement is obviously lagging behind. Therefore, improve the Government Green Procurement legal system is very important.Based on analyzing the Chinese Government Green Procurement legal system’s kinds of problems,we suggest perfecting the relevant laws and regulations, in the "Government Procurement Law" set discussed to the parties of the Government Green Procurement, the supplier qualification, the green purchasing list, and the encouraging measures for provisions.And the government should formulate corresponding implementing regulations to specificly rule the procedures for making the green purchasing list and the environmental product certification standard etc.To improve the government procurement management department and clear their responsibilities, Establish effective communication.Besides,the government should improve supporting measures of the Government Green Procurement to further perfect the Chinese Government Green Procurement legal system and realize the goal of environmental protection.The article is divided into four chapters:the first chapter is the preface, discusses mainly the government green procurement’s background and significance, emphasize the government green procurement’s powerful functions in promoting environmental protection and the green consumption in the international society.Combining the current research situation at home and abroad,to perfect our country Government Green Procurement has great significance. The second chapter discusses the Government Green Procurement’s basic problems. First,defines the concept of the Government Green Procurement, analyzes its features, and the functions; Next, takes America and Japan for example to introduce the evolution of the Green Purchasing, analyzes the development experiences of world Government Green Procurement; Finally, discusses the basic framework of the Government Green Procurement, which includes the principle, the scope, the standards of the Government Green Procurement and so on. The third chapter starts with the legal status and the present situation of Government Green Procurement in China, analyses the related laws and regulations which have poor maneuverability, the skimble-scamble standard, the limited purchasing range, the unsound management system, the blocked communication channel and so on. The fourth chapter, in combination with the reality of our country and the developed countries’practical experience, focus on suggestions perfecting the legal system of the Government Green Procurement, and strive to make our Government Green Procurement legal system effectively implement and achieve better results.更多还原
