商品流通领域市场监管的问题与对策

【摘要】 我国的商品市场取得迅猛地发展,市场体系在逐步形成。但是当前商品市场的发展还不完善,还存在许多缺陷,一些市场行为并不规范。这些不规范的市场行为,甚至一些违法行为经常扰乱正常的商品市场秩序。因为市场失灵需要政府这只看得见的手,通过打破市场垄断、查处不正当竞争、克服市场制度可能产生的外部性问题,从而对市场失灵进行干预。市场监管作为政府在市场经济条件下的主要职能之一,其目的是建立和维护良好的市场经济秩序。工商行政管理部门是国家的职能部门,承担市场监管和行政执法职能。多年来工商机关致力于整顿不规范市场秩序,使经济运行环境明显好转。随着我国市场体系的逐步完善,这就要求工商行政管理机关在市场监管执法工作中进行新的改革,以适应新经济形势发展的需要。基层工商行政管理机关处在市场监管第一线,担任着维护市场秩序的重要力量、促进经济发展的职责,作为窗口树立工商行政管理系统的良好形象。基层工商人员必须完善市场进入机制,规范市场主体行为,创造有利于市场主体发展的良好环境。基层工商人员还应加强监管手段和机制创新,以满足新形势的需要。要加强商品及其商品质量的监督管理,健全和完善商品入市、退市制度。市场行为主要包括市场交易行为和市场竞争行为。目前市场秩序混乱的主要原因就在于市场竞争行为不规范。规范市场竞争行为必须重点对市场经营主体,违背诚实信用原则,通过采取不正当或违法手段进行的排挤竞争对手、争夺市场,损害其他经营者和消费者合法权益、扰乱市场经济秩序的行为进行打击。本文按照“提出问题、分析问题、解决问题”的思路展开。本文以加强商品流通领域市场监管立论,对市场监管的涵义、特点及必要性进行介绍,分析了当前苍山县商品市场监管方面的现实性问题及其原因,着重探讨了规范和完善市场主体、市场客体、市场行为和监管者的方法,论证了完善商品市场监管的道德信用环境、体制保证等基本内容,以求从根本上解决商品市场监管问题,从而推动市场经济的发展。本文创新之处,在于提出完善市场监管机制,改进和加强商品市场监管的新方式和新手段。我们需要加强道德宣传教育,增强经营者诚实意识,完善市场主体的信用监管体系。我们应完善监管约束机制,加强对市场经济的经营主体规范和监管。

【Abstract】 China’s commodity markets have been developed rapidly, and the market system has been established step by step. But the development of commodity market is not mature enough, many defects still have existed and there has been many market behaviors that did not conform to the norm. These counter-normative behaviors, even some illegal behaviors have often destroyed normal commodity market order. Since we need the "visible hand"-government to intervene market malfunction by breaking up the market monopoly, investigating and dealing with unfair competition, and stabilizing market economy to maintain a smooth economic growth.As one of the major functions in the condition of market-oriented economy, the aim of market supervision is to build and maintain good market-oriented economy order. The Industry and Commercial Administration Authority is the State functional department to exercise market supervision and administrative law enforcement. It has taken great efforts to renovate these counter-normative doings, and have got good improvement for a long time.With China’s market system perfection step by step, that mean market supervision should be reformed to adapt to new situation. It becomes an urgent mission of the Industry and Commercial Administration Authority to strengthen market supervision. The Grass-Roots of Industry and Commercial Administration Authority are in the frontline of market supervision, serves as a vital force in maintaining the commodity market order, boosting economic development, and as the window for fostering a good image of the Industry and Commerce Administrative System.Grass-roots staff must perfect the system of admittance to market, standardize the behavior of market subject, and create an excellent environment that is beneficial to the development of market subject. Grass-roots staff should also make innovations in their supervisory means and mechanisms to meet the need of a new situation. Grass-roots staff should intensity the supervision of commodities and their quality, perfect the system of commodities entering and quitting from the market. Market behaviors include market transaction behaviors and market competition behaviors. Market disorder is mainly caused by market competition behaviors that fall short of the standard. In order to standardize market competition behaviors, we must crack down on improper behaviors of those managers who violate the principle of honesty and credibility, push their rivals aside and forcibly occupy the market through some illicit or illegal means, impair the legal interests of other managers and consumers, and disturb the normal market economic order.The thesis is composed in accordance with the principle of "raise the problems, analyze the problems and settle the problems". Based on strengthen commodity market supervision in the field of commodity circulation, my thesis introduces some basic knowledge such as concept, character and necessity of market supervision, analyzes the problems in reality that confront in the aspect of commodity market supervision in Cangshan County and its causes, emphatically inquires into the ways of standardizing and perfecting the subject, object, behavior, and supervisor of market economy, discusses and displays fundamental contents of environment of morals and credibility, institutional guarantee that are needed in the course of perfecting commodity market supervision, in order to tackle the problems arising in the commodity market supervision and push forward the development of market economy.The character of the thesis is that raising the original methods and measures to improve and strengthen commodity market supervision by perfect market supervision mechanism. We need to strengthen the promotion and education of morals, upgrade managers’sense of honesty and credibility, perfect the system of supervising by credibility. We should perfect the system of supervising and controlling, intensify the standardization and supervision of market managing subject.
