【摘要】 随着我国农村经济的不断发展,我国土地承包经营制度的弊端日渐显露,即其已经不适应我国市场经济的发展。因此,推动并保障土地承包经营权的流转是完善土地承包经营制度的关键。土地承包经营权的流转是指在保留集体土地所有权和不改变土地农业用途的情况下,原土地承包经营权人将土地承包经营权移转给他人,使他人成为新的土地承包经营权人的过程,这个过程不仅包括主体之间法律地位的变化而且还包括法律关系的变化。本文主要对以家庭承包方式取得的土地承包经营权进行研究,目的是通过对土地承包经营权的流转进行研究,探讨土地承包经营权的流转方法,实现土地承包经营权的有效流转,从而促进规模经营,实现中国农业改革和发展的“第二次飞跃”。本文采用了系统分析法和实证法等方法进行研究,在分析土地承包经营权流转现状和制约因素的基础上,提出了解决问题的建议。全文除了引言和结论外,共分为四部分：第一部分,通过对土地承包经营权基本制度的分析,界定了土地承包经营权流转的含义、特征以及现实意义,分析了土地承包经营权流转方式的基本内容。第二部分,分析了我国土地承包经营权流转的现状。第三部分,在分析土地承包经营权流转现状的基础上,对土地承包经营权流转的制约因素进行了分析。这些制约因素包括：物权化不彻底、集体土地所有权制度存在缺陷、流转方式混乱和受限、农村社会保障制度落后、流转市场不规范等。第四部分,针对我国土地承包经营权流转中的现状和制约因素提出了完善我国土地承包经营权流转的主要对策。本文在土地承包经营权流转的价值取向、土地承包经营权的性质、集体土地所有权、土地承包经营权的流转方式、农村社会保障制度、司法保护制度等方面提出了完善的建议,这是本篇的重点所在。更多还原

【Abstract】 With the development of rural economy of our country,the disadvantages of the system of rural right contracting expose gradually:it does not adapt to market economy. So promoting and protecting the circulation of the management right of land contracting is the key to perfect the system of the right of land contracting.The conception of the management right of land contracting is that in the premise of retaining ownership of collective land and not changing the agricultural use,the right holders transfer the right of land contracting to others and make them become new right holders.The process includes the changes of legal status and legal relationship. The purpose of the article is that form researching the circulation to perfect the system of the right of land contracting,carry out the circulation effectively,realizing the scale management of agricultural and "the second leap".This test mainly passes the system analysis method and substantial evidence analysis method.In the base of analyzing the current and constraint of the circulation of the management right of land contracting, we got the method to perfect the system.Besides the introduction and conclusion,the article can be divided into four parts.In the first part it is going to research the implication and characteristic of the circulation of the management right of land contracting and analyse the basic content of the way of the circulation of the management right of land contracting. In the second part it is going to analyse the current of the circulation of the management right of land contracting. In the third part it is going to ananlyse the constraint of the circulation of the management right of land contracting.The constraint include incomplete real right,defect collective land ownership,chaotic way,backward social security system of rural area and irregular market.In the forth part it is it is going to research the ways of the circulation of the management right of land contracting.The forth part is the most important of all. It put forword the suggestion of perfecting the circulation system in value,nature of the right of land contracting, collective land ownership,way of the circulation of the management right of rural, social security system of rural area and judical protection.更多还原
